Watch Our Sad Neighbour From Hell

Discussion in 'Lounge' started by NOODS X, Feb 5, 2020.

  1. I wouldn’t want my bins on my front drive mte tbh.. I made a custom storage space out back so they can’t be seen.. And no we don’t have anywhere near the space he does, what you see of ours is all we have eg mini on the front and a drop kerb with my golf parked legally on it.. in front of his house is unrestricted parking for all... just that you can’t because he’s always parked there..

So, if Mrs N wants to go out, I have to move my car to let her out etc etc etc .. x

  2. Yes I’ve filled in tonnes of council paperwork and kept records etc, but nothing actually happens..?

  3. am i right in thinking the parking restriction only applies whilst there is a vehicle parked on the property ?

  4. Er what parking restriction ? X

  5. say if your mini wasn't on your property and you drove off in yer golf, anyone could then park directly outside your property, yeah ?

  6. You can block access across a drop kerb, as long there isnt a vehicle that needs to get off the drive. By having a garage, you dont know if there is a vehicle, in the garage, that can be blocked......

    ...I think.....

  7. I tend to agree with that, up to a point

There are a number or ways to deal with neighbour/harassment cases, but they often end up escalating the problem before it gets better.

Reacting in kind just leads to a car keying and rose bush uprooting feud and/or fisticuffs on the pavement.

Reporting to the police is unlikely to yield results as although as @andyb correctly points out, what the guy is doing is a crime in that he is pursuing a course of conduct (2 or more incidents) with the intention of causing you fear, alarm, distress or harassment) they’ll probably “no crime” it unless something more serious occurs.

There is a potential tangential way to get the police interested though. IIRC you heard his girlfriend’s screams and so you called police. That makes you a witness or potential witness and his actions are capable of being interpreted as either vengeance for or trying to dissuade you from assisting the prosecution. Aka “witness intimidation”. Such a person’s actions don’t need to be violent or particularly intimidating and I once unsuccessfully defended someone who was on trial for that, the facts of which were that on one occasion he had stared at and then rolled his eyes at the victim (he had been charged with (indecent) exposure against one of his former housemates) and on another occasion he appeared to be waiting on the corner of her road and then filmed her with his iPad.

Alternatively, you can get a lawyer involved and have a “cease and desist” type letter sent to him but that can go both ways. It either stops the conduct dead in its tracks or it actually pours fuel on the fire and makes matters worse. Unfortunately some people see it as a bit of a game and they relish the “challenge” of debating with a lawyer and/or in addition to winding you up in ways similar to that shown on the cctv footage, it gives them an opportunity to compound the grief by abusing you by proxy via correspondence with your lawyer (and which you pay for the privilege of receiving and taking advice on). Only start down that road if you mean to see it all the way to court if necessary, as making a threat which you don’t then carry out is the worst thing you can do in such a situation.

Finally, you could jump in with both feet and apply for an ex parte without notice interim injunction, but that’s a ballsy move which you should not take without getting proper advice on the costs and ramifications first.

If you do decide to engage a lawyer PM me first as too many solicitors fanny around writing letters for months, wasting your time, money and energy, whilst also emboldening the harasser, who thinks that you and your lawyer are all bark but no bite.

  16. On this, I had last year a need to have an honest discussion with a neighbour who kept parking in front of my dropped kerb allocated parking place. I took a course of action that led to the other party calling the police.

As explained to me on that day by plod, if you have a dropped kerb and another party parks infront of it, there is little that you can do if there are no vehicles being blocked in, but there is if they are blocking people in.

so nothing can be done if blocked out but can do something if blocked in. The event was resolved in an unusual way but there have been no incidences since. I don't know if others have had similar outcomes?

  17. twas my understanding also, how was your events resolved ?

  18. Mush has a garage, how does anyone know if a vehicle is being blocked in?

  19. i like this ... keep recording the stuff even the noisy music, get in touch with whoever you spoke to or did a statement with and explain/show his motive is to intimidate you as you were a recent witness against him!

  20. When they parked in front of the dropped kerb, I blocked them in, made a few calls and had some other friends block the person in from the other sides as well, next morning they tried to go to work and couldn't. They called the police, police knocked at the door, I refused to move and said them knowing what they are doing will see this happen again.

Plod went to see the other party, an agreement was made that as long as they did not remove my own space from access for myself, I wouldn't stop them earning a living again. Been okay since
