Security

The Bacs central system itself is extremely secure, and there are lots of layers of security built into the processes that banks and businesses use to process payments through Bacs.

From a customer’s perspective – the security you see will depend on the type of payment you make. For instance only approved businesses are allowed to collect Direct Debits and in the event that anything goes wrong, as a customer you get excellent protection thanks to the Direct Debit Guarantee. **Regardless of the type of electronic payment, you enjoy the same level of protection. This means if you are an innocent victim of fraud that is the result of an ‘unauthorised transaction’, you can expect an immediate refund. An unauthorised transaction is a payment from an account which has taken place without the permission of the account holder. This can include transactions that are the result of a fraudster gaining unauthorised access to a customer’s account, but does not include any payments that the customer has authorised themselves. Your claim needs to be made within the 13 months of the fraudulent transaction leaving your account.

Payments require your authorisation in advance and your bank must tell you what information the payment will be processed on (e.g. account number and sort code). If you give the correct information and your payment goes as a result of an error by your bank, they must refund you immediately. The latest enhancements mean that where there is clear evidence of a genuine mistake, the receiving bank will prevent the money being mistakenly spent by the recipient of the payment. Although the improvements cannot guarantee a customer will get their money back, they mean that, for the first time, in straightforward cases where the recipient does not dispute the return of the funds, the money will be returned within 20 working days.

When you set up an electronic or automated payment from your account it is vital that you give the correct sort code and account number and name of the person/business you want to pay. If you give incorrect details your money may end up in someone else’s account and it may be difficult to get it back.

If your payment goes astray as a result of a mistake you have made (for example, by using the wrong sort code or account number) your bank must assist you in tracing the funds.

There are occasions on which payments made through the BACS (Bank Automated Credit Service) system can be recalled by the originator but, generally, this can only happen on the same day that the transfer was made and, it also depends, to some extent, upon the relationship between the two banks between whom the transmissions have taken place. Where, however, the Internet BACS system is used, there can be no recall after payment has been credited Recall is more likely to be where two parties have a history and make regular payments and have a business relationship not between two parties making a one off transaction.

So if you instigated the transfer as a one off payment from home on your computer as i often do for larger purchases where i don't use paypal this cannot be recalled.
I think you already mentioned that your bank have already told you they would not return the funds without contacting you first in your case. If it was taken back and you prove that money was refunded incorrectly, a sale agreement for instance, and proof that you agreed upon a specific amount to be paid by BASC - the bank are liable. BACS works, an unauthorised recall if fraud, otherwise every tom dick and harry would be recalling money in the hopes that they get their products for free.

If you disagree with the refund lodge a claim within 13 months and you will get it back if it is due..., reading between the lines however, i am assuming that the banks sorted it and you didnt disagree with the refund

I've just this second photographed the bank statements for the 11th to 13th November 2019 and have PM them to you....
unfortunately they are on three pages and not as I'd like on one page.
As I mentioned before I didn't disagree with the refund and was in fact about to ask Fitness4Less for their bank details to make a refund.
My point is that Santander did take second over payment without my permission or any contact with me.
I also accept that they really shouldn't have done, but in this instance it was ok.

Basically I think we are saying the same thing, apart from they do take money without permission and I accept that they really shouldn't have done.

If they take money without permission it is an error. Double payments can slip thru, especially if the bacs service they use had an outage. Normally it’s fixed before anyone notices. Something it’s missed entirely!
