Whats My Legal Rights?

  1. This is my scenario.

    1) Purchased Ducati approx 18 months old from a 3rd party dealer with local Dealer history.
    2) Fault appeared and booked into Ducati whilst in bike last month of factory warranty.
    3) Extended warranty purchased for 1 year offer by Ducati, under written by a 3rd party from what I understand, but offer by Ducati.
    4) Bike goes in for repair approx 6 weeks after factory warranty expired, but was booked in BEFORE factory warranty expired.
    5) Bike comes back, still has the same issue even though a repair attempt has been carried out.

    I don't mind if it goes back for a second attempt at the repair, but what would my rights be if its still got the same issue after that?

  2. Bike too old to be rejected under the sale of goods act. Ducati have to be given reasonable opportunities to correct the situation. To be honest I found that it was better to deal direct with Ducati uk with my warranty issues. The dealership did not convey the facts at all correctly. As soon as I explained the situation directly things happened very quickly and effectively. Best of luck.

  3. Booked before warranty means all ok but will help if you have proof of this. Its not your fault they are too busy.
    Bike not repaired ? Again, not your fault .

    Basically you reported the fault in warranty and its yet to be fixed.
    Some dealers will moan but thats their problems, not yours.

  4. I had to do exactly the same when I had problems with my first Mutley. A quick letter to the MD of Ducati UK and it was all sorted.

    I don't think the dealer will have an issue repairing it a second time and I don't have an issue with them having a second attempt, but I will have an issue if the second attempt fails.

Hate these grey areas because the degree to which the the manufacturer will get involved, particularly in something that occurs sometime after completion of manufacture, depends on how much the problem impacts/interferes with the function and enjoyment of the product. Gws that anything linked with safety is usually straightforward, items "wearing out" prematurely is another fairly high on the list of priorities but it seems anything beyond this is open to interpretation.
     
  7. The water pump from my understanding is a known issue with the Pani V4 and SF V4, the latest pump version is supposed to resolve the issue.

  8. glad you've revealed this, yes - there are a couple of threads on here, and I tried to help on one.
    Does it "partially fail" i.e. does it appear water pump is not cooling or working sufficiently?

  10. looks like an inferior gland design, something that has plagued some car water pump designs in the past also.

  11. water pumps can fail at random notice, new or old and it's rarely the gasket sealant in my limited experience, but I respect your viewpoint.

    Just wondering how many people have had their water pumps leaking?

    Mine was in getting 7 recalls and TSB's done and they discovered my water pump was leaking and they have another one in the workshop leaking as well.
