Hi everyone I sold my first fireblade and upgraded to a more track-specific fireblade back in May this year. Both bikes are '09 models. The guy i sold my bike to texted me tonight and said this: "this bike you sold me isn't legitimate, you can buy it back from me or i'll have to contact the policeman. tried to sell it and the mileage has been clocked call me so we can resolve this" I responded that it was sold in good faith and he was delighted with it when he bought it. He responded "the MOTs don't match up in mileage. Was mot'd one year at 10k the the next year at 5k. I am unable to sell the bike due to this. I paid you £X,000 for a bike that i cannot sell so is effectively worth nothing. I would like £X,000 (£1k less) of my money back and you can have the bike. I did buy it in good faith and was under the impression it has no faults however as i've explained it does" OK, so i am "not that guy" that buys and sells bikes often and i certainly didn't try to do anything wrong in this sale; i had actually spent £1500 on the bike fixing starter issues and prepping it for 5 days on track. Any advice guys - i'm not minded to buy back the bike as i have my new track 'blade. But don't want to risk legal issues etc. Is the guy correct, have i done anything wrong, can he go to the police about this? Thanks for any help!
If you didn’t know, you didn’t know… and it’s the buyers responsibility to make checks against the history of what they are buying… with the likes of carverticle etc.
I'd go to a solicitor. Find out for sure the legal position. If it's in your favour have them send him a letter. Otherwise he'll keep on. He might still, but it'll be much less stressful if you know the law is on your side.
Have you checked the MOT history yourself to see if his claim is correct? That would be my starting point. It has taken him 5 months to establish that the mileage is incorrect, that seems rather a long time to me.
I agree, and 4 months is outside of even any basic selling regulation even for a dealer let alone consumer p2p sale
It’s not unsellable. It probably had a click change at some point so just needs to be called out and the real miles (estimated change plus wheats there now) is declared. If fella didn’t have the checks, it’s buyers problem. Been caught myself on this twice and now do all the checks. I have an S4RS that had clocks changed. Ok it’s actually documented but it means it hasn’t done 6k it’s done about 18
There is no reason why he could not sell it with that mot milage discrepancy, it could of had a change of clocks at some point or the chap testing could have just entered the milage incorrect (happened to me twice). Sounds a bit scammy to me.
And don't take DVLA's MOT / mileage history as definitive. Testers do make mistakes. When I checked the DVLA / MOT history of my current car it had a discrepancy where the tester had clearly just entered a wrong and higher number which was basically a number-anagram of the right one (as indicated on parallel history such as service invoices - do you have those?).
OP I'd delete his texts, block his number, and forget all about it. Don't waste your time or stress levels on it.
Not necessarily. IME it depends if the insurance has paid out and if the insurance company want it back.
