Hi, any legal experts who could give there opinion,I would be very grateful. My daughter parked her car this morning, on a street near the hospital where she is a student nurse on placement. There are no parking restrictions at all on the streets, but the people on the street don't like non residents parking there. When she went back after her shift, the car was gone. It had been towed away for causing an obstruction. Sh has a picture of it parked, with the time and date and there is absolutely nothing on the street, so if there was an obstruction,it was not caused by her parking. Just wondering where we stand on this. Trying to talk to the police is an absolute joke. There was even a sarcastic message chalked on the pavement next to where the car was Cheers
Pay the fee & forget it, I've had dealings with lawyers/solicitors & it's just a money dump usually with regrets & hindsight. But hey, if you got loads of mullah dot dot dot y/t BlackBeltBarrister - he'll set you right.
a local newspaper would love this one i reckon, that is just wrong. The "before" pictures will prove invaluable.
Local council will tell you if there are any parking restrictions where she parked. If not a CPZ area and she wasn’t causing a danger to traffic ( parking on a bend etc). Then without pics it’s difficult to judge. If it was lifted that would suggest a parking infringement had occurred.
Can you post the pic she took? It seems strange that the Police would tow her without any grounds for doing so. Was she parked close to a junction or facing the wrong way? If the car wasn’t causing an obstruction then by towing it away and impounding it, the Police and their contractors have committed the torts of trespass to goods and conversion. She could make a claim for damages, although they’d be fairly nominal, along with the return of whatever fee she had to pay in order to release the vehicle from the pound.
I'm just wondering, why would you take a picture of your car, parked in a perfectly legal place. Strikes me as odd. And then, incidentally it gets towed?
She had taken the picture because a neighbour had approached her and complained about her parking there although there are no restrictions. Another had put a note on the car
I think you need to get a picture of the sarcastic message on the payment if you haven't already, Evidence is key here.
can't understand why the police don't want to help, I'm sure somebody on here will explain. if I've gathered this right, this looks like a personal problem with the house or houses to the right of the car in the picture?
Called the police several times to be told the officer who is dealing with it will call you to which I replied, he won't though he. He didn't. Called back and was told a seargent would call so I could complain. He didn't.
