Actually, I've been contemplating in this...not only did you exchange for a mere few trinkets what some think is a work of beauty and rarity but you did it to a Frenchman! I think they should double to fine and back date it!
I've sent them links to the ebay sale which clearly show it sold at that time. I've got photos of him collecting it, it's shown in his workshop in France as well as FB. I can email him, but I get the feeling they are happy I sold it, but the fine is because they didn't receive the V5 telling them! The thing is I can't prove I posted it, it's my word against theirs
I only sold it because I built my Radical Pantah instead. It was a keeper until that point, but I knew I'd never ride the Baines if I could use my Pantah.
These guys appear to have succesfully defended this position with DVLA DVLA Failure to notify new keeper fine court case dropped
Worth contacting him in case dvla did have to send him or the french equivalent something confirming the change of owner as that would confirm they received it from you.
A bit more information from this document http://www.direct.gov.uk/prod_consu...n/@motor/documents/digitalasset/dg_065264.pdf What to do if you are selling your vehicle privately to someone that does not have a GB address You should fill in sections 6 and 10 with the new keeper’s name and address. Both you and the new keeper (buyer) must sign and date the declaration in section 8. Give the whole V5C to the new keeper to aid registration abroad. You should then send a signed letter to DVLA, Swansea, SA99 1AG giving the vehicle’s registration number, the make and model of the vehicle, the date of sale or transfer, and the name and address of the new keeper. Once we know about the change of keeper, you should receive an acknowledgement letter to confirm that you are no longer responsible for the vehicle. If you do not receive the letter within 4 weeks, please phone 0300 790 6802. If you are deaf or hard of hearing and have access to a textphone, phone 0300 123 1279 (this number will not respond to ordinary phones
Thanks Chris, that's a good website. I've appealed and I'm waiting for the paperwork to arrive before I draft my letter. I'll seek some legal advice on this as well, just to make sure I get it right!
I know it is me but I would take them to court. You sold it and can prove it, guy collected it and you can prove it. You have other vehicles registered presumably at your new address so how come they did not try to contact you there before case went to debt collection? It will be a case of them proving they did not get it over you proving you sent it (both cannot be done) so it will endup on common sense approach as I do not see any other way. Good luck and have fun.
Thanks Peter, I've also got access to a few legal bods through work so I may look a that option as well. A bit of research seems to indicate that it's a civil matter and to enforce the fine it'll need to go to court. There seems to be a fair bit of legislation around this, but I've yet to find any stated cases?
I had the same with a DRZ400e that I sold, I went to court with receipts of sale, copies of the V5 that I had kept, I also had moved home, I had another vehicle on a SORN, my other bikes and cars were taxed insured etc etc etc. Clerk of the court had a word with me prior to the case asking if I was pleading guilty or not. I stated that I was not, and stated that on the balance of probability I had informed them and that it was down to the prosecution to prove the case against me and then briefly set my case out and he dropped it there and then. They are a typical Government ticky box organisation. Good luck buddy.
I've been having a similar problem with the DVLA for over a year. I scrapped a vehicle in 2011, 4 days before the tax ran out. I got a letter a year ago telling me I owed £80 for not taxing a car I had scrapped. I wrote a letter to the DVLA as they requested detailing the scrap dealer, the dates, certificate of destruction, all the business. No response. A year to the day later I get another letter from the same debt collection agency asking me for £80 for the same vehicle. I sent another 2 letters to 2 different departments (4 letter total, recorded delivery) and got no reply. Now every few weeks I get a letter telling me to pay £80 or the boys will come round and cut my toes off with a spoon. And then, to top it off, I got a letter reminding me to pay tax on a van I sold in 2013, 5 months prior. So that's 7 pieces of post, amazingly all from me that have disappeared in to the ether. And the zx6r I bought last summer, the v5 for that didn't show up and it took me 3 months to get the paperwork. Cocksuckers. I'm not paying the £80, it doesn't show on my credit report and if they want me to go to court I shall tell them AGAIN why I'm not paying them their imaginary fine!!!! I'm certain they use mail for toilet paper as a cost cutting measure. Bastards.
Nick, I think you need to take action on them for harassment! I can feel time off work, sleepless nights, anxiety depression...it's all building up - these cunts need to be taught a lesson
Try this when you move next time. https://www.royalmail.com/personal/...keyword=forward the mail&creative=27573233053
I had a similar issue with a Landrover i sold, it rattled on for months in much the same way you describe, in the end i threatened to go to the media and also told them i was going to sue them if they didnt stop harassing me, never heard another thing from them.
