Playing devils advocate, my understanding is that in both cases it was not so much the acts themselves, more the fact that they were performing them in places where they could be seen or caught (ergo some form of gross indecency)

It's my understanding that bike shagger was in a YMCA room, when housekeeping (or whatever) knocked and asked if anyone was in there. When he didn't respond, and Assuming the room was empty they entered to find him riding his bike.

 

If fucking a bicycle in a locked room is a crime, we are all guilty.
