Knocked Off - Insurance Question

  1. Hello, not the first type of post I wanted to post on the forum but hello anyway.

    I picked up a new 899 last week and a car reversed into me as I was stationary today.

    There was an emergency vehicle getting through and the car infront reversed into me knocking me off the bike. The fireman came out and helped me pick up the bike.

    The lady driving said she panicked and just kept on reversing even as both myself and hubby kept on pressing the horn.

    Damaged parts are broken brake lever - and scratched bar end. The lower belly pan had vinyl shield but the rear brake lever must have flexed and marked the fairing. 2-3 stone chip size marks on the clutch cover. sob sob. I know not most serious of accidents but was still running the bike in and my first ducati too.

    I guess my question is(MCE insurance)

    is it worth claiming for? I presumes I have to pay an excess and will lose my no claims until it settles?

    If I claim - can I choose the ducati dealer I purchased the bike from?

    If I go through insurance - will they list it as a cat d or etc with the damage above?

    Lastly, I can only assume its an open shut case - but are there any chances when being reversed into isn't the car drivers fault?

  2. Totally car drivers fault, there is no rule in law that states a vehicle must move out of the way of an emergency vehicle, so the driver of the car is 100 % at fault. Get in touch with her insurers, before contacting yours.
     
  3. Have you spoken to the other party re insurance? They may not want to go through theres if they have an excess. I would get a quote for the repairs and try to settle with cash. If you go through insurance you will have to pay the excess until her insurance settles. It wont be a cat D unless damage is so much that it is more economical to write bike off which it doesn't sound like in this case.
     
  4. or you hold off and demand her insurers repair your bike without you being out of pocket.
     
  5. Most insurance companies will want to choose where they send it for repairs, as said by the others get a quote as the damage does not sound too bad, submit it to the owner and ins co. They may just pay you up if you make it clear it's the cheaper option and your only looking for the cost of the damaged parts and no compensation etc, sometimes they will choose the cheap and easy option and even pay you directly.

    What will upset you is you should declare you have had or been involved in a claim/accident and that could effect your renewal premium.
     
  6. My wife recently had a lorry reverse into her car whilst she was stationary behind it, there was a bit of to-ing and fro-ing between the insurance companies which our assessor told us was 'all part of the game, but they WILL pay.' and indeed they did.

    The law says that it is the responsibility of the driver carrying out the reversing manoeuvre to make sure that it is safe to do so, which evidently they didn't - regardless of the fact that an emergency vehicle was present. That's why our insurance assessor was so confident that we'd win.

    Contact your insurers with the other party's details and make a claim on their policy. If you have fully comp', your insurers may just tell you to get the bike repaired and they will then send the bill onto the other party's insurance company, which is when they'll say 'It's not our fault', your insurers say 'Oh, yes it is, we'll see you in court' and then the other party pay!
     
  7. You have to contact your insurers, if there is a claim to be made, and police if any injuries, MCE are not the best, so be very strict and tell them in no un-certain terms, NEW parts, and you choose where it goes.

    you will have to pay excess but they should recover that too, and then should not effect your premium next time
     
  8. God help you with MCE and all the pain it is going to bring you. Defo contact the people who reversed into you and ask if they want to settle for cash if you provide them with a bonafide parts quote . Do not contact your insurer, they should contact their insurer and start the process of a claim as it's their fault. After that's done then you can contact your insurer,as I mentioned dMCE is a total nightmare so do not alert them first, keep us informed.

    Contacted the car driver - apparently they've already reported to their insurers and they prefer to go through the insurance as its a company car. Guess I'm going to wait for their claim reference number before I call mce then?

    Would it still be painful from MCE even if the other insurers already agreed fault then? Surely there shouldn't be any to ing and fro ing - wasn't much I can do if a car reverses into me even as both hubby and I were pressing our horns desperately. In fact, he nearly dropped his bike too trying to stop me from falling over and broke his switch gear as he caught his bike.

    Will they take the bike away for long? I need in 3 weeks for a planned trip though.
     
  10. This sounds crazy but they may well just write it off and give you a new one. It'll be assessed by one of their own assessors first? And they calculate main dealer hourly rates, book price and come up with a magic number.

    I've bought a couple of cat d bikes that cost only a few hundred pounds to repair myself.

    Ask if you can have a bike to cover the trip?

  11. The good news is that they have got the ball rolling, but I think you might need to contact and advise your insurers of the incident and that the other party have reported it. I recently had someone go into the rear of my car,their insurers The Allianz called me next day to admit liability, send me a hire car while they sort the repairs to my car,all done very efficiently. Their insurers should send an assesor,who will note the damage. Tbh it's nowhere near a write off,a Ducati brake lever I'm guessing £25? Bar end £10, fairing panel say £375. What I might do is get a cheapo brake lever to use while you go away and agree to get the repairs done on your return. Also you can insist that the repairs are done at a reputable Ducati dealership,don't accept whoever they say they will use,you are in control.

    Not nice to read of any accident but glad your ok
    Declaring no fault accidents will affect your premium it did for me and by quite a bit
    My quote for the monster was £409 I paid £95 for the SS
    My car insurance went up too as I had to declare the bike accident
    I just had my car written off outside my house I was no where near it and my car insurance has now bumped up by £100!!!

  17. Just called my dealer and they want the bike there asap before the insurance send their own specified centers.

    Can i drop off my bike to the dealer before anything has been agreed with the insurance companies and tell them to contact the dealer?

    As my hubby was on the other bike behind me - can he act as witness?

    I guess worse come to worse - the fire truck would have a log of the callout and the fireman may recall the incident since he helped me pick the bike up?
     
  18. If you haven't done so already*, write up and keep two things:
    A. A fully detailed note of the incident, recording every possible fact (place, road layout, date and time, vehicle descriptions & reg numbers, drivers details, etc)
    B. A fully detailed note of the damage, recording all the damaged components with part numbers and dealer quotes for prices, and costs of repair works.
    If the case turns into a dispute, and the driver at fault (or their insurer) turns nasty and uncooperative, you will need all that material.


    Then make up your mind what you want and claim it - you might get it. The most common reason for people not getting proper compensation is because they either don't ask for it, or can't justify it.

    * Better to do it on the day as soon as possible, and note when you wrote it.
