Only for her already wanting to go through insurance, I personally would of left it and asked the lady if she would be happy to cover cost of parts repaint/replace and just charged her second hand costs. Say £250-300 all in. You have no ins hassles, no waiting, no taking bike to dealers and more waiting and no insurance cost rise next year.
Check your policy. I believe in just about every case, you are obliged to report any accident on the public highway. Whether or not you or any third party intend to claim.
As Loz and others have said you are obliged to report any accident, whoever's fault, to your insurer, so you are in breach of the Ts&Cs if you do that. You might dodge an insurance quote increase next year, but if you had an accident, and an assessor turned up and spotted undeclared DIY repairs from a previous accident, they would be within their rights to refuse to pay out. We all know what sods insurance companies are so it makes no sense not to play it straight.
If you have a car or bike stolen, and then another two or three stolen as well, any insurance company will regard that as a higher risk and will charge more. The fact that being a victim of theft is not your fault has got nothing to do with it. Likewise if people keep on damaging your vehicle while it is parked or stationary - the same applies.
in my experience it will increase your premium. last year a police van hit the mirror of my van which was parked. smashed the mirror but because of the hassle of getting quotes and getting the repair done, I did not claim. no claim was made, no money was paid out at all but it went down as an "incident" and increased my car, van and bike insurance. I appealed to the ombudsman but they said there was nothing I could .
Since its going to affect my premium anyhow, I may as well claim for everything that ended up marked. My dealer wants it back asap - I actually need to drop it of for them to resolve an issue too. Can I do that or do I have to wait for insurers to "agree" to drop it off at the specified dealer? Another question is will my hubby be allowed to be a witness since he was a bike length behind me and saw the whole thing unfold?
your dealer want's it back, because he can repair it, making money from the repairs. You can take it to your dealers. You now have a big cash cake, that everyone want a slice of. Yes he can be a witness. You're lucky they didn't claim you rode into the back of them.
You are entitled to have it repaired at the place of your choice so long as they are suitably equipped and qualified to carry out the work. A main dealer would fall into that category and if they try to tell you otherwise ask them to confirm that to you in writing - it will never happen because they are not allowed to do so.

I reported the incident to my insurers and they have said that i have 3 options. 1. to claim on my own policy 2. the insurers will provide assistance and claim on my behalf but will not touch my own policy 3. do nothing and for me to deal with the other persons insurance directly. I opted for option 3 but they said they will help me using option 2. Today, i got calls for repairs and hire bikes? Confused? If i'm not claiming - why are they trying to provide hire bike and get my bike assessed? I told them to hold off. I also contacted the other party's insurance - they are saying they have not yet established liability? I thought this was pretty straight forward. When i queried why this was not established - they said they were waiting on a response from their client whom seem surprised when i told her this. Is this normal? How long would it take to establish liability if their client is saying she reversed into me? btw, they said hubby can't be a witness as he is not independent. However, I managed to track down the fire engine rescue team who said they witnessed the whole and tried also to stop the car reversing into me and they are happy to be witness - infact they logged what happened on their logs? I'm dropping bike off to dealers - can they start repairs or have to hold off until other party's insurance authorizes it? Thanks again

When someone went into,the back of me,their insurer phoned me the very next day admitting full liability.
Because they're in league with companies which make a fortune out of the process: they provide you with hire bikes at exorbitant cost, and the cost is passed to the other insurer. Problem is, sometimes the other insurer refuses to pay the exorbitant cost; and where liability is contested you can end up responsible for the cost of the hire bikes yourself. So tread very warily. Husband cannot be a witness, no, but that you have the fire guys onside is a big result.
Absolutely correct. He will obviously be treated with less credibility than an independent but is a witness none the less.
Its the end of Friday now - The other persons insurance company still has no updates in establishing liability. I've called maybe 20 times in the last 5 days and have sent witness details and anything I think relevant (not a statement since they haven't asked me one but I provided anyway). All I have done is speak to india call centres who are often rude and only say no updates- send email. I've been trying to speak to their investigations team in UK, but that itself is a mission. I've tried calling through central switchboards etc, only name I can come up with is the email confirmation of receipt by x person who may or may not be handling this case. I've been telling them I will be dropping my bike off to the dealer and they say please let us know the dealer contact but no updates. How many days do they need to investigate a case where their client reverses into someone. Even the client txted me saying that when she chased them, they said they were waiting on a statement from myself(no one told me that) which I promptly sent to this random email that was given to me by the call centre. So far, I've not received a single call, email or any form of contact from them. I am giving them an opportunity to pay less - a lot less. All I am asking is a quicker resolution as I have trips planned. Since I have independent witnesses and my hubby, can I presume liability can not be contested? And if its not contested - can I hire a bike then? If the insurers want to take 6 weeks, that's 3k right there (and its the cheapest hire quote I found). I can't imagine if I went through my own insurers hire team These indian call centres are killing me softly.
Hi, As soon as someone admits liability and says they don't want to pay cash go option 2. Look at it this way, their insurer doesn't want to pay your bill, nor are you their customer. They aren't going to be any 'help' at all. Give your insurer the evidence of fault and tell them where you want to take it for repair. They will then answer all your remaining questions. You can hire a bike while yours is off the road and bill to them for that too, just ask your insurer about it!!!!!!
