Both were 'mistrials' .....A 'mistrial' is not a 'miscarriage of justice' ..... If both of those cases were brought to trial today, and evidence presented correctly, they would almost certainly be found guilty again!
The death penalty is not a deterrent. Being locked up for life would prevent the murderer from doing it again just as effectively. There were no doubts in the Stefan Kiszko, Bridgewater Four, Sally Clark and Barry George (Bulsara) cases. All released after anywhere between 3 and 25 years.
Just want to hope he`s not living near you though . I know he`s not living near me . But if he had been executed he would not be living next to anyone. And yeah it would have made a difference to her dad who didnt turn into an alco till after his release. Like I said earlier if it happened to your friends or family you might think different . Hopefully you will never find out.
You're right, I do hope he doesn't live anywhere near me. I would prefer he was still locked up and from what you say that would have helped your friend as well.

It might. MIGHT, have dissuaded that person in the first place. And with advances in technology it is possible to prove absolutely that someone did something. I guess this is one subject where everyone has their own opinions and very rarely changes them no matter what.
Life should mean life... No release ever. Death penalty with absolute proof and in these cases there is usually enough DNA evidence to prove guilty. The poor father who's daughter was butchered has his own life sentance. To let a butcher like that out is madness. you can not rehabilitate these beasts. They are wired up all wrong .. We know what is acceptable in life. If you experience Ill treatment of an extreme kind you would think nothing of pulling a trigger or a switch. Not just because what you suffered but to make sure it never happened to another. The sad fact is we do not lock and throw away the key. They know play the system and they are out for " good behaivor" Even the prison officers hate them!
Unlikely, anyone prepared to go to those extremes is not thinking about the consequences. in some cases, but the burden of proof in a case involving a capital offence would need to be more than DNA evidence. It is not enough on it's own to convict for a prison sentence. That's true.
Plus of course we are all forgetting Section 32 of the 1994 Criminal Justice and Public Order Act........which takes a way the requirement for ANY corroborative evidence in a sexually motivated crime......and the Judiciary, as quoted by Baroness Schloss, are "fully aware" that there are in the "low tens of thousands" ( think about that for a minute) of men falsely imprisoned under this act here in the UK, and they KNOW they are falsely accused and innocent yet because of the above act, its a question of word against word.......and if they can make that size fuck up and choose to NOT put it right, do you really think they'd worry about executing someone if they werent sure? Forgiveness is easier to get than permission as the old saying goes......
Yes you need the whole caboodle. Sadly this country is just too soft.. Also over stretched and overcrowded prisons. I just speak from what I know from work. Some other issues I have experienced myself. Also from living next door to a prison officer who had his face slashed and had to move... Because he was attacked by one of these nutters. Yes it was his choice of Job I know.. But. If anybody spent a few hours listening to what these poor children who survived have been through and the fear they suffer daily knowing that person will be released... I think it would break anyone's heart... If it didn't then I would question if you had a heart and soul. There is NO excuse to abuse or kill a child , it is not right in any circumstance or normal . I just can't fathom punishment is prison and protection... Sadly they still get there kicks inside .. And fed and all they require except freedom , which to be honest I don't think meant that much or they would not have committed the crime is the ultimate punishment is prison. They for filled their ultimate fantasy and now have years to relive it in their heads. Some punishment.....
Sadly in the case of rape charges it works two ways.... There are men banged up on false charges. And there are women who are terrified to go to court because it gets thrown out. Or nobody believed them. Our system for serious crime like this needs overhauling . I agree of that. This is why conclusive proof is so dam important. However getting back to the offence in question. The only saving grace was Sarah's law . Which came about after little Sarah Payne. That has helped. It's a start ... Let's just hope more and more of these sickos get caught and stopped and the victims get the help they need.
Cant disagree about proper punishment Mel, but there have been too many mistakes in British law to assume the authorities can be 100% sure...how many times do they fabricate evidence ? The cases that come into the open are the tip of the iceberg sadly.......and yes, I could quote a few cases that friends have been involved in..and believe me, despite one of them being a policeman at the time, his " colleagues" in another force ( who have to be called in to investigate another copper) manufactured so much bullshit you would NEVER believe it.....its all about KPI's these days I'm afraid, they dont give a toss who they convict as long as they meet their quota......
I think he should be put back into his society and let them be the judge of his demise. I think he was about to fill up on vodka and set himself a light before he was caught!!! I can't imagine the horrors that little girl went through but what in this country protects these kids. This is such an emotive subject There is no deterrent to stop this happening apart from prison and who these days worries about it. Death penalty should be the last resort after every avenue has been checked and verified
Interesting views being expressed here and in the heat of the moment some people would have an eye for an eye. So if you're out speeding on your bike this weekend, there's an accident and a child dies presumably you should be put to death too?
Stefan Kiszko happened to be sterile and could not have produced the semen in the rape which presaged the murder. The police and prosecutors at the time knew for certain that he could not possibly be the guilty party, but concealed this from the defence and managed to secure a conviction. Many years later the facts came to light and he was released, after his life had been ruined. There is a very long list of comparable cases, some still in prison today. To the bloodthirsty forum members who so readily say they are in favour of the death penalty, I wish to pose a question. It is not about some distant, hypothetical hate-figure, it is about you yourself. If you were found guilty of murder, should YOU be executed? If you feel absolutely confident that you will neither commit a crime nor be wrongly convicted, you may choose to answer yes, which is fine by me. Sentence yourself to death by all means. The rest of us and the civilised world could get by rather better without you, I expect.
If I was out on my motorbike with the full intention of not stopping until I had systematically tortured and killed a child over a protracted period of time, days, months, years, then yes, I consider the Death Penalty to be fair. What are we talking about here? Pre-meditated torture and murder is not the same thing as causing death by dangerous driving, other accidental killing, killing another in self-defense, or any other the other things that the fucked-up English justice system places under the nearly useless umbrella term known as "murder". Wake up. We are talking about predators who think nothing of killing the weak and the helpless, who are so far outside the morality of society they are practically off the planet. If someone is convicted of a crime, it's because there is no reasonable doubt or because they were fitted up, perhaps. Perhaps we shouldn't send anyone to gaol in case they were fitted up too. Mistakes happen. I fail to see how having your life destroyed by a false conviction is in any way better than having your life ended by one. If they are innocent, serve time for whatever period, have their pictures in the paper and are basically destroyed as a human being, is this merciful compared to executing them? If I were convicted of a heinous crime, I would not want to hang around for an over-turned conviction after five-ten-fifteen years. What would I come out to? Who would I be when I was released? A new life with new opportunities? Hardly. There is a chance that the sub-humans that murdered the Bolger child could breed. Their genetic material could find its way back into the gene-pool. That prospect fills me with dismay and horror. I don't want revenge, I want to know that their kind is gone from the World. Yeah, I'm extreme. It's an extreme world out there, little bits of it anyway. And please don't accuse me of over-reacting to the latest horror show. I've held this belief for a very long time now.
I dont disagree with you Loz, in fact, I'd go further in saying that EVERYONE should be chemically neutered at birth, and only on passing an exam at about 30 would I give anyone the antidote to allow them to breed.......But as you say, we do have a fucked up system of Justice here......in fact, we dont have a "justice" system,. just a system of administration of the law.......two VERY different things....
If he's convicted of this horrible crime! i hope he gets hell in prison. Anyone who kills or rapes a child deserves to die a painful death! Steve Father of 3 young children
