You mean you declared that both the Arrow pipes had the stamp "Not for road use" on or you mean you declared that both the bikes had an Arrow after market pipe?
The latter and that they came fitted by dealer as part of triumph deal never mentioned the stamp. Imagine the fallout if they all said we aren't paying out on these cans. How many thousands of bikes have ducati and triumph shifted because of a free official accessory pipe deal.
Ducati as with all bike/car dealers have a legal responsibility to sell you a road worthy and legal vehicle, so if ducati are selling bikes with Termis that are technically not road legal then they are in breach of their legal obligations. I'm quite sure everything is as it should be.
You would think so wouldn't you, that's why I started this forum topic, though there might be 2 types of end cans, I always have bad luck so didn't want to get myself into bother should i claim. When I asked the Ducati dealership salesman directly whether these Termis were road legal and I could declare then to the insurance as that he said "NO". On Monday morning I am going to phone several dealerships and ask them the simple question "Are these 899/1199 Termis you are selling road legal"
It's a fair enough question and a question that should have a straight answer, however I suspect you won't get a straight answer but a lot of varying answers. It's a bit of grey area from the sounds of it and there's nothing wrong with wanting to know where you stand. It's a lot of money to buy the bike in the first place then more money to insure it and we all need and expect the peace of mind when we take out insurance that they'll come good if the worst happens. I think there has to be some sensibility with it though. Where is the line drawn. Do non standard after market rearsets, levers, comfort seat even a tinted screen fall foul of the insurance companies rules? Who knows!.
Not really, I just like asking direct questions & expect a direct answer. It's either Yes or NO, no bullshit, no grey areas.
Ok, here's no bullshit every set of termi's I've had or seen have had "not for road use" . There is your answer. What people are trying to explain to you is that everyone is in same boat. Asking a numpty in an insurance call centre if fitting a non road legal can is ok , what answer do you really expect? They've proably got visions of non silenced flame spitting bastards. So calling dealerships isn't gonna change that. Nobody is going to stick their hand up and say they are road legal are they? If Bob at Ducati wonderland parts department says "yes bananaman, they are road legal". Then what? Your insurance isn't going to suddenly pay out cos a bloke who sweeps up told you what u wanted to hear. No dealer will put it in writing when the cans tell you all you need to know.
So having read the above the answer is NO, the termis are not road legal and therefore need to be declared to the insurance company?
Well that said it! But true words. If a bike passes it MOT then it's road legal including the exhaust, and if the bike is road legal the insurance company has no reason to have a problem. Just declare non standard cans and don't mention anything else as there's no need to unless they ask you the specific question of 'are your cans road legal' then you've answered honestly and to the best of your knowledge and just pretend you've never seen any etchings that are hidden on the backside of a can in the hidden depths of the bike - like the rest of us do!
The cans need to be declared as a modification. That's it. No need to start telling them anymore. I've never been asked if they road legal.
If it bothers you that much. Send me the cans. I'll modify them to be read "road legal" . It'll involve a Dremel. £100 for this service.
All the insurance companies I have got quotes from have 2 questions: 1 Any modifications? (Yes aftermarket exhaust), they never ask for the manufacturer (termi, AKRO etc) 2 Is it road legal? (Not sure I'll get back to you, erm NO) The demel thing to remove the stamp is nonsense, only good for MOT, do you really think the insurance companies are that thick. Anyway this has been a good discussion, think I have made my mind, find someone that doesn't ask the road legal question. Buying the bike regardless.
If the bike is used. How would you possibly know they aren't road legal if the stamp wasn't there? Anyway , buy the bike and all these worries will disappear once you hear that termi rumble.
Really, in the all the years I've insured bikes and cars I've never once been asked "is it road legal".
Anyway I see your picture is taken at Ribblehead Viaduct. I have a picture of my bike taken from the same place. I think it's the law that if you pass there on a bike you have to stop and take a pic with the viaduct in the background. I go on that road up to Hawes regularly in summer. I'll keep an eye out for you on your Pani - with Termis!
