I Wonder If This Applies To New Bikes And Used?

  1. Under the new Consumer Rights Act 2015, motorists are now guaranteed 30 days to demand a full refund if they buy faulty goods, a law which extends to buying both new and used cars.

    Previously, car dealers were simply obliged to repair the car by replacing a faulty part if the car had a problem, but the new act will finally turn the table in favour of the buyer for the first time.

    Any licensed dealer must now provide a refund for the sale price in full if a buyer returns a faulty car within the 30-day period, and it’s hoped this could also squeeze dishonest dealers out of business.

    The Consumer Rights Act 2015 also provides extra rights for buyers once the initial period is up, with dealers obliged to replace or repair faulty parts for up to six months after the sale date. Buyers can also demand a reduced price if the dealer doesn’t fix the problem the first time round.

    However, Pete Williams, spokesman for the RAC, noted that the responsibility for this is on the consumer, saying: “The responsibility will lie with them if they are to benefit from the new law. This is likely to lead to some difficult disputes between dealers and buyers.”

  2. What's to stop a buying getting a car, f-ing it up, then demand a refund at the dealers expense?
     
  3. They same thing that is stopping dealers claiming that that is exactly what you did, to get out of paying the refund.

    Not a lot.

  7. Nothing at all!. Whats to stop someone taking a car to the Nurburgring thrashing the fuck out of it, Bring it home and make the car develop a fault (easy done) then demand a full refund.

  9. I hope there will be conditions to this law on the used vehicles in the car sector .
    We sell used cars and the things folk come up with, inventing faults that are not there because really what they have bought now is not what they wanted , they drive it for a few weeks and think "don't really like this now "and try to give bit back saying its doing this that and the other and yes of course there is some genuine knackers that get sold and the owner deserves his/her money back , it's going to be fun .......
     
  10. I have been looking in to this and its not as black and white as it seems. The consumer has to prove the fault was there at the time of sale. So advise to car/bike dealer/traders is:

    Do a multipoint pre delivery vehicle check sheet signed by the buyer
    Fresh MOT
    Checked by an independent garage

    So should a fault manifest itself after sale and within 30 days if you have covered your ass the buyer can not demand a full refund. That's when the warranty would kick in anyway.
