I'm afraid that doesn't really clarify anything in my view IF evidence shows MM caused the crash himself by turning into Rossi thus Rossi's actions of running wide not being the cause of the crash. If MM had not crashed and there had been no contact I'm sure the incident would not have even been looked at. Therefore if it is shown MM caused the collision/crash then 3 points on Rossi's licence just for running wide is excessive. A rider is entitled to run whatever line they choose. Although I do think Rossi was a dick running that wide/slow it is within the rules so long as it is not dangerous which it wouldn't have been if MM hadn't persisted and turned in onto Rossi and his bike. It's not as though we don't see every race the rider infront running wide on the exit of a corner forcing someone slightly alongside their rear wheel to back off to avoid either running off track or hitting the rider infront's back wheel.
The FIM are indeed the rule makers, but they have to follow their own rules and just because they make the rules does not make them the final arbiter of those rules, which is where CAS (and possibly even higher courts ?)comes in.

No, Rossi did. My point is just that it's 6 of one and half a dozen of the other. You employ certain tactics and can't much complain when you find yourself on the receiving end of them.

I agree. But that's a bit like saying I don't have to obey the laws of this land because I can always appeal to the European courts if punished for an offence. The fact that there is a higher body, doesn't make the rules irrelevant. Anyway, as I've said, the rules aren't being questioned. The punishment is.
I see that CAS have said there will be a decision this afternoon (expected around 3pm) on the request for a temp suspicion of the grid penalty. Not long to wait. Place ya bets. I reckon they will uphold the FIM decision, partly cos they know it opens a whole new can of worms if they don't. But part of me wants to be wrong.
At Assen Rossi was a way ahead and MM smashed into him in a do or die attempt. If Rossi had that as his plan as that was the only way he could win then he must be fricking psychic!
At the risk of being pedantic I would disagree and say that it is the interpretation of the evidence i.e. what actually happened and whether that constitutes an infringement of the rules before any punishment is even considered.
No but the law can and is often influenced by politics and money. If they suspend the penalty and VR becomes champ and later at the actual hearing they uphold the FIM ruling, then imagine the uproar. So if they suspend the penalty they create difficult questions for themselves down the line and potentially leave who is ultimately World Champ for up to a year when they have the final hearing.
My understanding is that if the penalty is suspended it will be served next season at Qatar and not influence the WC outcome for this season. What that would do is do away with anything Race Control says and each team would come with their own lawyers
Rossi cheated and was punished, lightly. Rossi is huge and the penalty will no doubt be overturned or postponed allowing him to take his 10th title. Lorenzo already realises this hence him wanting to attend the meeting. I neither favour nor dislike rossi and marquez. My eyes witnessed what happened. I am an innocent bystander. I do know Rossi's entourage will be catered for though.
