So I bought an 848 from a dealer in December and I have had ENDLESS trouble with it. It's a great bike but when I bought it electronics didn't work, lights didn't work, had to get them repaired. Noticed a few things like cracked front subframe. Slowly and by sinking money I've been fixing all these errors and getting people like Neil to fix it. Now bikes in for a service and there's loads of metal and aluminum filings in it. Looking like it's going to be a massive repair job. I have this bike in finance and it's my first sportsbike. I've only had it since December and I feel like the dealer did not look the bike over properly and sold me a quick sell. Am I stuck with this in finance or can I contest as I have solid proof of the repairs and the things that basically made the bike not road legal such as no baffles. Do I have a leg to stand on
one of my customers is going through this at the mo brand new and battery goes flat after a week) he approached his lawyer who informed him to contact his finance company as technically they are the owner. if you bought it from a registered trader or dealer you have a warranty weather they say so or not. the finance company are now dealing with it.
Yeah i have just been Advised to do the same and am now dealing with the finance company. The dealer originally took absolutely ages so i got Neil at Cornerspeed to do the Electrical Repairs. Now the bike is currently sat in the garage at Ducati Nottingham waiting for my next move. As they could go to the root of the problem but it could cost me out the ass and after only having the bike 4 months should i be paying this much out i mean i could have paid off half the bike by the time i finish with these repairs. I just asked the dealer if they service the bikes when they get them and they say they dont service every bike as they have 300 odd bikes. So am i basically fucked with a used bike thats having loads of issues. Or do i have a leg to stand on. The bike came basically not road legal, No Baffles, Wrong ECU, No headlights working. Then theres other stuff like Cracked Front subframe, electrics basically bodged together. Obviously this was my first buy as a new biker is this down to my error. My brother and a few friends bought their bikes from CMC and im kinda wishing i did now, or i just bought one new as the finance deals are much better. They have looked after them and the bikes have come serviced and perfect.
It is probably best to have a look on a government website or CAB for correct advice. What he said above!
Yes you do and it's not too late! Firstly,I've been a retail car dealer for over 42 years so I'm not guessing- I've had just about every type of litigation and legal shit come my way in my time so I speak from experience? The one thing that always made us jump into action and try and resolve a situation with an unhappy punter was when the punter contacted the finance company and threatened along the lines of "why should I be paying monthly payments with healthy interest when the motorcycle is clearly not right or fit for purpose?" The implied threat of you stopping making your payments (don't stop as your credit rating will suffer!) will get the finance company to put massive pressure on the dealer to resolve this situation immediately- dealer finance companies often supply stocking and funding plans for the dealer to operate.The motorcycle they sold you is "unfit for the purpose you purchased it for".Go on web and see if there is any other blog/complaints about the supplying dealer,also office of fair trading/trading standards etc and check if dealer is a member of any trade associations.Above all don't lose your rag and write down a log of problems/expenses incurred from day 1 to date and keep all receipts for costs you have incurred.Find out if dealer did the MOT test on your bike and ask them how they can have passed a motorcycle that sounds like is in a dangerous condition? I never worried about punters who came in shouting and threatening me but I always took notice of a man with a file of paperwork containing chapter and verse tales of woe - cos they don't go away! I forgot to say - it's a bonus but not law or cast in stone that a dealer selling a used motorcycle or car has to service it before delivery to new customer but any dealer worth his salt,values his reputation and his customers will carry out a full safety check,check levels and probably do a minimum of an engine oil and filter change? When they replied with "we have over 300 motorcycles and don't service every single one they are fobbing you off and totally disrespecting you as a customer.I think they cottened on pretty quickly that it's your first motorcycle purchase (maybe you even told them?) and think they are just gonna mug you off out of it until their warranty obligation period expires and they can start presenting you with some juicy bills? A great deal of car and motorcycle dealers still believe that so long as they take the motorcycle/car back and agree to repair or rectify your list of faults they are home and dry - total bollox! What will get things rolling is a county court summons for full purchase price,every penny you have spent on repairs,even taxis or buses that you have paid out Everytime it's let you down! Also make sure you name the finance company as well as supplying dealer as defendants - bet you will be sorted before the sun starts shining? Don't drag your heels - download forms tonight

Get a proper written report on the bike and it's condition from a recognised vehicle inspector (even some body like the AA should be able to do it).......then submit copies to the original dealer and the finance company requesting that the finance deal be undone and all your expenses incurred (report fee, repairs etc) to be refunded including finance payments.
Unfortunately it may be too late to involve Trading Standards and the 'Not fit for purpose' approach as TS normally expect a complaint within three weeks of the purchase, plus as some repairs have been carried out by the OP, TS will probably say that the OP has accepted the vehicle. The finance company will hopefully take a better stance than TS.......The OP could try talking to them before getting a report to see what they can actually do and what they will require to be able to take action.
Some guidance here - County Court claims go up to £10,000. I took Airtours to the CC a few years ago and won refunds - it's not like a criminal court and you put your side to a judge, whilst the other side put theirs, and a decision is made. All the more reason to take a knowledgeable mate along, if I was buying an 848 as my first ever bike and be willing to splash some serious cash on it i'd wanna be sure the bike was kosher...or am I missing something?...having said that ,I hope he gets things sorted.
I totally agree! It's one thing going blind into a Honda main dealer and buying a commuter/runaround bike - but an 848 is different gravy entirely! Bit like going to swimming pool for 1st time and trying an inward 3 and a half with pike and a couple of twists off the 10 m board? Hope when he wins the lottery and fancies a track day he doesn't splash out on a 7 Litre Lola? Could get messy
Come on , ease up, he's made a mistake, I'm confident he feels shit enough about the situation without a top up.. He's posted for advice on what he should do , not what he should have done.
