The legal people for these companies are saying that the picture of your car entering leaving forms the contract We asked what planet they thought they were on, the guy got really shirty We have said that it doesn't form any contract When you contact the parking company legal team they will ask for an account number I tell them I don't have an account with them, they don't like that either and will continue to keep on even when they say they are there to help all they want is the money.
Yes, provided they meet requirements for visible signage etc. The Beavis case now means they can pursue penalties beyond actual cost to them, and the provisions of the Protection of Freedoms Act 2012 allow them ro transfer the debt to the Registered Keeper whether they were present or not at the time of the "parking incident" or not. There are rules and limitations for all of this however, not all of which are followed properly by companies who prefer to write threatening letters with impenetrable legal references. Good luck and let us know how it goes.
The wife got one the other day, parks the same car (distinctive red RRS, with distinctive private plate) 3-4 times a week in the same place in the same station carpark. Returned to her car last week to fine a parking penalty charge even though she'd paid for the day on their payment app. Their system had reverted to the original VRN of her car which although was obviously a red Range Rover Sport parked in the same spot as it always is they issued a fine. She contacted them to tell her story but as they had no record of her paying for her parking because the system had defaulted back to the previous VRN (even though it was assigned to a red RRS) they declined her appeal even though by coincidence the red Range Rover they issued the ticket to had paid for parking for months. She's to law abiding to push it any further and paid up against my advice I hasten to add.
Got a fine once, appealed on the basis the parking lines/ demarcation wasn't clear, lack of maintenance wasn't my problem. It was scrapped. I assume NI have adopted your Act as an Order.
P Write to the company claiming the monies and tell them you do not accept Any liability for parking charges and did not enter into any contract with them because no signs were displayed where I parked Ask them for a VAT invoice Do not appeal as you have nothing to appeal against as you did nothing wrong
OK. What should you do if you receive what purports to be a parking penalty notice of some kind? A. It might be a valid notice properly issued by a proper authority and based on accurate facts. In this case you should pay up. B. It might be a notice issued by a proper authority but based on some error or misunderstanding of the facts. In this case you should make use of the appeal procedure, and lodge an appeal setting out fully and clearly your valid grounds for rescinding the notice. C. It might be a scam issued by some chancers who issue lots of junk notices in the hope that a percentage of recipients might pay up. In this case ignore it and any follow-up communications. So the first thing to do is work out whether the notice is of type A B or C - based on reality, not indignation and wishful thinking - and act accordingly.
B for my requirement though Pete why would you appeal rather than notify if you have done nothing wrong when you could notify them that they have made a mistake thereby removing any attempt to create joinder which In turn would bring the parking notice to life when you want to kill it off?
I think the MotoGP is a reference for indigo are they collecting unpaid fees on behalf of silverstone their client? From what I can see PCN is indigo They will try to tie you up in knots sending letters from different debt collectors so be on the ball PCN Payment
PCN admin act for all the private firms and just put PCN Indigo and PCN (who ever), PCN are collecting the fee for, " our client (the creditor) ,INDIGO PARK SERVICES UK LIMITED MOTO GP I have a separate ref number. Ive been checking the car park numbers of were i was parked and it seems the car must have been cut in half and put in two separate place's at the same time. Just now looking to try and find a link to a good template letter to send, one I've found one but won't open, i just don't want to put to much info and put myself in it etc. Again thanks to all
Did you park without paying? if so what made you think you could rock up to silverstine and park your car for free? silver stone parking has to be paid for according to their website. See website for details
No i didn't park without paying as there was no signs and no pay and display that told me i had to or any parking attendants telling me i had to pay to park, i was in a field. when i do drive into a carpark i check what the charge is on the signs or p/display machine.
Didn't know they did park, ride but think thats just F1, still saw no signs for a parking pass or ticket. They never used to charge for Silverstone but as usual in this country its a case of how to take more from the public, perhaps i won't go next year and will do another Europe GP instead, been to Misano a few times and there a free bus picks you up and takes you back, Its the same with the NEC show you have to pay to park, not been there for years, i don't always moan honest
Thats hilarious. Even they admit that its 'often overlooked'. Wonder why that is!!!! Thieving expletives. How much is the ticjet to start with. Greed. Ignore it 100%. Theyre chancing it. I remember going to alton towers 10 years ago to find they wanted £15 to park..... After paying entry and exiting through the gift shop many times I drove out of the hotel barrier after threatening to bust through it. Id sooner walk a mile than pay to park. 1.5 miles and my money is in the machine.
