Confused...tacho, Trailers And The Law

  1. No I'm not talking Mexican food or a new country band.

    I've a 3.5t Sprinter panel van (fully loaded ~ 3500Kg) and a tow bar for my bike.
    V5C states Trailer ...Maximum un~braked 750Kg and braked 2000Kg, so in theory 5500Kg of metal and rubber coming at you.

    The van is my work van for my Air Conditioning business (limited).
    I own the company and therefore the van.
    Clearly passed my tests before 1st Nov 1997, so I can tow.

    Some people say it must have a Tachograph fitted and others not.
    The guidance on the web is slightly confusing.

    I believe that as I'm not using it for hire ( never hire it out) or reward (I don't use it as a taxi or deliver pizza) I'll be exempt from the O-license requirements.

  2. Try reading Articles 2 and 3 of the attached. You would appear to fall within the exception listed at Article 3 (h).

  3. Is your van the twin wheel hub version. If so then that is rated as having a weight capacity of over 3.5 tonnes and therefore needs a tachograph. You can have the twin wheel version down rated whilst keeping the twin wheels. The van is physically the same but is just not allowed to carry as much weight. Big trouble if you get caught over the 3.5t limit.
