A question or two.

  1. Not that long ago I received info that I am being tracked down by City of London Police for speeding offence.

    Today I received notice of intended prosecution with details of the incident (time & place) plus proof they have.

    First off all what struck me there is already explanation why cameras on tower of London bridge are not visible and it is fault of national heritage ;).

    However pictures of contravention are at night so there are only 3 photos on paperwork (there is place for 4).

    First zoom of plate,
    Second is so dark you can barely work out where the lights and plate are,
    Third wide angle version.

    On any of the photos driver is not visible at all (not only face) and there is no way to make out location or if there even is correct marking on the road to see speed limit or measure vehicle speed.


    Do I have any options? Not saying I did or did not do it.
    - It was a rental car and road markings around that area are a joke.
    - If you do not know the speed limit for that Bridge length you are very likely to go over it as road leading up to it and from it is 30mph while bridge is 20mph. Entire Bridge length there are only 3 markings for speed, all are drawn on the road not a road sign. From direction car was going and position of 1st speed marking you have an option of looking if junction is clear before entering or looking in front of your bonnet (not ahead) to look for signs.
    Both is not possible, traffic coming from right, 1st marking ASAP on left, then speed camera, then 2nd marking.
    - Speed recorded is 28 mph which clearly indicates driver was aiming at 30mph max.


    Current form is in essence expecting me to admit I was the driver during time of offence and that details on paperwork are correct.
    I did have a car rented from that rental company but as it was in November 24th of 2012 I do not remember time I was in the car and where in London, do not remember if plate on my car is one on the photo and have no receipt to check that.
     
  2. Hmmm tricky, this is where if u were pulled by a person and not a cash camera, a living human being may have be sympathetic and let you off. In the eyes of the law i suppose its cut and dry but a judge may side with you. But I think you would need video/photos of that juction at that time of day same road position and time of year to support your case. But im no lawyer.

  4. As above I'm afraid, but then if I'm in the wrong I'll admit it. However if I'm innocent I'll defend myself to the last!
     
  5. Having read so many posts from you Lucaz regarding speeding and stopping in restricted zones I can only assume you are a hardened criminal who deserves to be locked up.

    Just say it was a mate from Poland driving who has since returned home, any name with more consanents than vowels should do it.:wink:

  10. On a serious note the hire company will and have said that YOU and presumably only YOU, unless YOU say there was another name on the hire agreement, had possession of that car on a hire agreement during that time. They have complied with the name the driver.

    If YOU were not driving, then YOU will have to say who else was driving the car YOU hired......oh and then there is the small matter of YOU getting that person to come forward and they do chase these up to the ends of the world and the 14 days does extend, along with them showing their insurance, oh and the little matter of getting the hire company to say that it was being driven by that person with their consent.....
     
  11. What if the driver is no longer in the country?
    In this instance you may be requested to provide proof that the person exists, was in the country at the time of the offence and that the driver has returned abroad or has gone abroad for an indefinite period. You may also be requested to prove that the person was insured to drive the vehicle at the time of the offence. If you are unable to provide this information you may still be prosecuted for failure to supply the details of the driver or for permitting the use of the vehicle with no insurance.

  14. Good on you SOUP if you feel every thing any one from gov says is your fault you accept as truth. I have paid parking/speeding fines and I have wiggled out of many others.

    Simple rule lead by example if they done their job correctly, did not brake any laws/rules in process and I got caught I will pay up. But why should I pay, even if I done the mistake, when they on purpose do not bother to do their job correctly. If they do not bother why should anyone else?

    There are normal, visible road signs around national heritage sites all over UK and London. Yet mysteriously they can not be present around Tower of London Bridge, still they could fit speed camera as long as not orange. I smell a rat there a mile away.

    - Bus lane ticket where sign indicating operation hours was twisted wrong way around I did not pay. That was a year ago Lamberth council still did not sort out the sign, why?
    - Westminster council issuing me ticket on private grounds did not pay.
    - Beckenham council having no parking sign 2m above ground on lamp post, sign size of 2x credit card. All as you enter the road. You do not look out for UFO when you turn in to side street but rather ground bound pedestrians so no way to see sign.
    - Lewisham council a ticket for parking in car bay and not displaying ticket. I only asked them where are MC bays as was under impression 10% of parking bays have to be for motorcycles as per Mayor of London. Never heard from them again.
    - Greenwich no single/double yellow when I park, when I come back ticket and single yellow. What is worse those who painted it moved my bike to paint then put it back where it was on wet paint.

    November stopped on taxi rank to pickup a mate, 1 min at best. Got ticket, I knew rank was there but did not think they will fine for picking up. Paid and moved on.

    In situation below I guess you would also pay?

    A102 after Blackwell tunnel south bound. Speed 50 going up hill, speed camera lines on the road start. Pass the crest of the hill is a small sign reducing speed to 40mph (half way through speed camera lines) and a camera that takes picture of you ASAP after that.

    Got a speeding ticket there of 50 in 40. Did not pay and went to court. It was clear to be a scam, nothing to do with safety.
    It worked clearly to generate tickets, you go 50 and enter speed camera markings so you keep 50 trying not to go over. Suddenly when you just at the crest you see a sign of 40mph and before you react you in 40 zone plus camera picture on it's way.


    Rule is simple you as driver have to obey road rules and read and obey road signs. However authority placing the signs has obligation to make them visible and readable at any time of day and any weather.

    I also got a ticket for using Olympic lanes, that was easy to get out off :) I think they did not want to bother to test the rule in court.

    For me it is clear if road is properly marked 30 I do 40 and get done, even with hidden camera, I will pay. Any other case will the least check my options.

    I know that but just checking Andy. Saying that I left a hertz van back at their place about 09:00 and went home (another story) a week or so later got congestion charge ticket at 09:30 in the car...... Hertz paid and charged me plus costs. It took me 4 months to get my money back despite receipt saying returned at 09:03. I do not hold much trust in rental company's providing correct details all the time.

    That did not work for ages man.
     
  16. This is just another one of those classic 'How do i get off with this' threads..........rather than the very rare, 'i did not do this' thread.

    knock yourself out and go for it, risk v reward. However more often than not the fines + penalties for deceitfulness far out weigh the original offence.....

  18. I've driven countless times over that bridge. Its not as clear as a bright yellow 6' sign but you can see the cameras and you can see the warnings. If you dont see the first you notice the speed limit signs and the cameras and its a 2 + 2 from there
