It reminds me of that Top Gear where they reviewed all the knock off cars. I remember him saying that, the government of the manufacturer basically got to decide wether there was any breach, and of course they side with their own.
They will get nowhere - the Range Rover Evoque was copied as JLR launched the Chinese built genuine one - called the Land Wind !!! Even with all the investment in China they got nowhere!
It's cool a looking bike, if I were a 17 year old Thai in the market, I might have bought one - it can even make ice creams melt!
Having been on a "IP in China" seminar with a Chinese IP expert yesterday I know the reason why the Evoque was copied as opposed to any other Land Rover, which you obviously don't.
I'll take that as you don't know the real reason. So I will tell you. First of all China, despite popular opinion, has stringent IP laws that cover and protect both Chinese companies/manufacturers and foreign companies that export to China. The reason why the Evoque (and only the Evoque) was "picked" out for copying by the Chinese was that JLR, having decided to register the design for all it's models around the world actually forgot to register the design of the Evoque with the Chinese authorities, leaving it wide open to be copied, which it was and was marketed as Land Wind. By the time Land Wind had launched their model they had also registered the design and had beaten JLR to the punch. Chinese law does not recognise "Prior Art" and as such JLR, despite it's legal protestations, had missed the boat.
Good luck to them, more bike manufacturers the merrier. There is only one iconic Ducati brand to be far.
