Urgent Advice Please

  1. Advice I'm after is to do with a bike ive just bought of a dealer 4 to 500 miles away, basically I purchased a bike that I was told was truly immaculate and also said that in the add, Turned up tonyt by courier and surprise surprise theres a small dent in tank and a poorly repaired rip in cenre of seat, Never mentioned this to me, Before I phone first thing in morning where do I stand with this?, I had to sign for the bike so I wrote on the delivery note about these faults and the driver signed it for me to confirm, He also took photos, He will be dropping of the delivery note to the dealer tomorrow and speak to them about it, I want to go the right way about this and would have an idea how to deal with things just incase there not going to play ball,

  3. Sorry chap - but firstly I've gotta say that car/bike dealers love punters like you! He is gonna go the "acceptable wear and tear for age/mileage" route? Your only prayer is if in his advertising description he stated "immaculate,mint,unmarked,as new"etc.A trading standards officer or a small claims court official will say that by the mere fact the goods are used and not sold as new you should have a reason of expectation that there will be signs of wear and tear.I would suggest keeping your temper and phoning the garages sales manager to discuss your dissatisfaction at the marks/faults and try and blag some sort of goodwill payment of say £300/400.Im not a pub lawyer- I've been a car dealer/garage owner/motor trader for 42 years and I've been through your situation

  4. Just out of interest- the seat material looks like an older/classic Japanese type motorcycle? How old is the bike,what is it and what did you give for her if you don't mind me asking

  5. Bit harsh . . be cool and honesty will prevail .

    You bought in good faith. . From somebody 500 miles away did you inspect it before purchase?

  6. Harsh??? Would you marry a girl without meeting her first and trust her uncles description of her? No such thing as good faith - it's 2017 and integrity,openness,Honesty,my word is my bond left the building in 1960.If a sellers description was 100% correct and impartial- he would never close a deal? If a person isn't confident or experienced mechanically in the way of motorcycles or cars he must have a friend who can check it over? Surely?

  7. What age/model/mileage is your new bike? Looks like an 80's Japanese Suzuki to me but that's a shot in the dark! Let us know please because the age has a major issue with your complaint
     
  8. Jack bought the bike off a dealer, i advised him to contact them.

    Whats your issue ? I dont want to marry your daughter thank you. I am happily married.

In his 1st post he states he bought it unseen (apart from a few photos!) and took the sellers description as correct and gospel.The mere fact is that the seller had a vested interest in glossing over any faults,wear and damage.One mans collectable classic is another mans bitsa junk.He owns it,paid for it unseen- a valuable lesson learned I think

I've not got any issue chap.The guy posted for honest advice and obviously isn't well versed in motorcycle purchase.He knows he has made a mistake but he is lucky it's a cheap mistake and can be addressed and repaired to a decent standard for small outlay.And leave my daughter well out of it

    I dont appreciate your comments i orignally stated go back to the dealer with pics.
    I would suggest Jack knows he has f**ked
    up but is looking for positive feedback to resolve his issue. I wish him luck.

    Ps. I am no "Chap" too you, or care to visit this forum again in a hurry, i see nothing has changed. .

    I will leave Jacks issue with you as you clearly have all the answers.

  12. He is asking for honest sensible advice and opinion on his best course of action with the dealer? Which is what I messaged him,frankly maybe but with the benefit of 40+ retail car sales experience.I see no point in glossing up his chances and the dealer won't need to see photos of the dented tank and badly repaired seat trim - he knows every scratch,dent and fault on the motorcycle because he's been looking at it for weeks or maybe months? I wish him good luck! Goodnight

Did you buy it on-line / if so the surely you are covered by the "distance selling act" also the new 'consumer act" states you can return within 30 days if product not fit for purpose....your cost on delivery though as your problem you bought it from a dealer so far away...just a thought

    I understand your issue - but it will be tough to get any action from the dealer - because it does appear to be an older bike - and as has been said it may be immaculate for a 30 year old bike with 20,000 miles - but his description of immaculate includes wear and tear that is age and mileage related - your immaculate compares it to a new bike.

    All I suggest is that calmly say the bike condition to you is not how it was advertised - and as such you would like a refund / compensation for the damage.

    He can argue damage in transit also.

    Then it will be down to the dealer and whether he values his reputation or money more..

    10 years ago - I bought a Seat Arosa - 7 years old with 5000 miles - also described as excellent condition - i paid a deposit - then when i gt there found that the car had had damage both sides (rubbed against drive posts) and been BADLY painted (home job with tin)

    I talked with dealer - he offered me full refund - I wanted car - so we agreed £400 off to allow me to have the sides professionally painted - the damage. - BUT all that was at his site.

Bikes a 2002 Harley fat boy(12k on clock) with a load of mods which I bought from a VERY large dealer in York(I'm 20miles from john o groats) so wasn't possible to view before buying, I was told it was immaculate and as said so did the advert(no mention of age related marks), I paid well over the odds for the bike which I don't have a problem with,
    I'm 48 and tbh ive bought the bike for my dad whos 72( hes be a great dad over the years so why not), All I really want to know is where I stand if they just flog me of, Hopefully they wont, All I really want is a little compensation to fix these things(not asking much?),
    Theres no point me just phoning and just flying of the handle when no need, This is the reason I thought to ask this on here before and not after, Ide never have bought a bike private over the phone just for this reasons,
    I'm going to speak to someone such as dent devils to see if its possible to get small dent out without paint,
    Appreciate the sensible comments above,

  19. I think you got good grounds. Thats not immaculate in anyones book. Dealer should compensate.

  20. This is the bike as probably a few of you gathered, I'm not downing the dealer in any way as they may well be a gem when I phone 2017-07-23 13.03.02.png
