The key in regards to the figure is based on 2 parts, one is the pensions bill for those brits who served in the eu trough and two, those projects the eu wanted to do expecting the British cash to always be there, this is what they are classing as moral costs. There is no legal frame work for the moral costs and in most cases there is no cost as there is no project, they want us to pay for the eu's future despite us not being in it. Black and white, there is no legal leaving fee to pay and the eu know this. as to the law question, it could not be simpler but in true remainer fashion the eu have tried to make it complicated. If you live in the U.K. you come under u.K. rules and U.K. jurisdiction. If you live say in France or anywhere in the eu, then you come under that countries laws and ultimately the eu jurisdiction. The eu wants eu residents who decide to stay in the U.K. to still be covered by the eu jurisdiction and not the U.K. jurisdiction. This would mean a two tier legal system within the same country. The eu does not do this to any other country that is not in the eu so why in the U.K. We are doing okayin less than 2 years we will be out of the eu with some parts transitioning at a slower pace but most of the important parts will be back in the U.K. for U.K. residents to decide where we go next.
