One thing is not paying ( don’t really care if he is late with payment) but another thing is refusing all communications with me , not answering calls/texts. And not paying on top of that. This is what bothers me. Whenever I met this guy before he alway had his phone in his hand, never let go, so there is no way he doesn’t know I am trying contact him
wend round to the flat last night. lights are on everywhere , but no-one to be seen. put a note through letterbox saying that if he will not make contact by end of play Monday I will be entering property with my set of keys out of concern for his and my property wellbeing. (anyone know if I have a right do so) ? spoke to me previous tenant (he moved in to bigger flat in the same block after 2 years in mine) and he told me that postman gave him letters from British gas last week for my flat (by mistake) and they addressed : to occupier. which means guy didnt register with anyone for bills? will call council tomorrow to find out if he is paying council tax or not. I bet he doesn't. anyone knows if I am will be liable for the bills while he is there/? have proper bad felling about it. don't really have time to deal with this shit
I would contact all the services you know that used to provide service and see if they are being charged to your old tenant , new tenant or occupier. I'd also contact plod and say to them you are unsure if this person is attempting to use your property for fraudulent purposes. If he is doing what he is doing now, there is a chance he's done it before. Or as you have not heard from him you are worried about his well being could they check on him, which would mean them entering to check. Did he give any references, did you check them out? I ask as they might be able to contact him ? Sounds silly but have you googled the name he gave you?
In that case you probably have a genuine reason to enter, I'd call local plod and see if they wish or are required to be present just in case he's done an Elvis!
When was Novembers rent due? I have tenants and one is sometimes late paying, but always catches up. I send a really polite reminder by text, nothing that can be used against be as evidence of harassment. You see the tables can soon turn on you and you are seen as the criminal and costs are suddenly imposed on you? What contract you got in place? Hopefully it one that allows you to inspect the premises giving 48hrs notice, follow that to the letter, maybe use the excuse of a safety check. You cant charge in all guns blazing, any threats implied in writing can burn you. Welcome to 21st century UK where everyone else has more rights than you do.
Years back I illegally evicted a tenant of mine. He had a history of bad payments so much so I took him to court for arrears which he agreed to pay but failed to do so immediately after. Then one day without notice he disappeared, after a few months of trying to contact him I decided enough was enough and the decision was made to enter the flat. I changed the lock and 'carefully' bagged his belongings and stored them in the basement. The property was refurbished and re let. Then I received a letter from Shelter the housing charity, claiming their client had been illegally evicted. They were seeking compensation to the tune of £25,000! I didn't really have a leg to stand on and was guilty of the eviction! After a long exchange of letters £13,000 was settled on and paid. This was a good few years back and his tenancy was started before assured short hold agreements were introduced. In the eyes of the law this was a 'protected tenancy' and as such enjoyed special privileges. Thankfully things have moved on since. Years later I got a phone call from a very distressed landlady asking me if I knew the tenant in question, as he had pulled the same trick on her! This guy it seemed was a serial bad tenant! In this case I would give the tenant 48hrs notice of intention to enter the property, use voicemail, text and written letter under the door. Hopefully he's legged it and this will be apparent, if he's still occupying the property and refusing to pay then it's a meeting with your solicitor next. For eviction to take place you will have to have secured the deposit and had an EPC report. It's never a good time and I fully understand the position you are in. Good luck.
I went to a property last week for a letting agency to look at some repairs and the place was being hot bedded by eastern european building workers. probably about 10 living in a 1 bed back to back terrace house in shifts. The place was really tidy, but the bathroom was wringing with condensation, 10 showers a day in a bathroom with no ventilation, the property isn't up to commercial use. Guess the original tenant is quids in, single council tax and his rent paid plus a profit from the others.
Get proper legal advice. Don't change the locks, enter the property or even send too many letters/text. Don't communicate in a menacing way. They have a Right to Quiet Enjoyment. Too much hassling can put you in breach of tenancy. Keep a file for record of all contact, copies of all correspondence and take pictures. Keep your gas safety certificate up to date etc. You will have to behave like the model landlord, or this may bite you in the ass when at court. Did I say get proper legal advice??
did you do a reference check on the tenant before they moved in? have you a copy of their passport ? you are legally required to verify their right to live in the uk before they move in access to property? give 48 hours notice as per the rental agreement and visit property does your rent agreement provide penalties / interest fro late payment ?
so after been trying to get hold of tenant for over a week with no luck, called him today from my office landline and he answered straight away and hang up as soon as he realised it was me. absolutely raging, but been advised not to do anything harsh and get everything done legaly. starting eviction process today using section 8 which apparently may give me back posession of my own property in 4 months or so. fucking fuming... not really a money thing here. it will cost me a lot of money to get rid of him. but it is not about money. it is about little worm getting in to my property and thinking he can do anything to me.
Feel for you dude, thats the very reason I got rid of mine after 12 years, 1 Tenant and only 1 late payment (he bought his girlfriend an engagement ring with the rent money) I got off lightly and couldn't bare to go through what you're going through, good luck
thats i more property out of circulation thanks to current tenancy laws. there is no way i will be letting it out again. 4 months to get back to my own place... they fucking kidding me!

Did you let through an agent? I just tell the agent I need access giving a couple of days notice and they inform the tenants.
Do you have his email@ I would email and call leaving a voicemail if necessary and also a note through the door giving notice of when you will be accessing the property not much more you can do. Other than an unfortunate burglary where all the tenants stuff gets nicked.
Did you get a reference and or guarantor? You have to play it straight down the line. Write to him in good time to inform the inspection is due and that a cert gas safe engineer (Give details of who, to include registration number) will attend. Give a date and time. Ask them to confirm with you that the date would be ok. Include a pre paid envelope. Keep copies of everything, even take pics, if poss, of every letter you post (It is best to hand deliver with a copy of the days newspaper) You may need to repeat this a few times. Express how important the cert is for their safety. If still no reply, inform HSE and the council of what is happening. They can gee things along. You have to fulfil your landlord duties to the letter. Even if he gets in contact saying the boiler is fkd, or a window won't close, you are duty bound to repair. Give them no ammunition against you in court. I won't scare you about the condition of the property after they have gone... Please get proper legal advice. It really is worth the outlay.
