When I was on 6pts and doing 105 on M23, instead of another 6pts I was given 5pts. I provided a letter from my employer at the time who stipulated that I needed my license for work and would likely loose my job. However, and isnt there always a however, I was given an increased fine. (from £250 to £700). All in a year I got 11pts. Thus I had to tread carefully for 4yrs. Good luck.
If you ask for a photo they will request you identify yourself on the NIP before letting you have it. However, I am fairly certain it will only show the front view of your bike and no reg plate. I don't think vans have a forward facing camera to catch rear plates, otherwise the van wouldn't bother with the rear facing camera - but I could be wrong with that bit. Therefore someone had to note down your number. If it is said it was the camera operator, he would have to have a rubber neck to catch your plate as you whizzed past the rear of the van. So someone else probably noted it down. However this does give some difficulty for them in court because it means two 'detection devices' had to be used (camera and eyes) and thus some unreliability in the evidence - someone has to have really quick reactions and really good eyesight to catch a number plate at 100mph before it is lost in the distance. I think it is definitely worth approaching solicitor to see if a road traffic expert barrister can spot a way out. Anyway at least check out the wording on the NIP ie; are the bike details correct; is the road referred to correctly (eg, call it a restricted road, which it isn't) etc.
I've just checked my licence on the GOV.UK site and it says I have 0 current penalty points.... bonus, thought I still had 6 points !!!
Camera vans in Hampshire routinely operate both forward and rearward facing cameras simultaneously to record vehicles travelling in both directions. Having triggered one camera, the second records you after passing the camera van. Happened now to at least 3 riders that I know. Andy
Yes, it will be a 'Do your worst attitude'....... ........"OK, Original Stanley Poster, you will go to prison for three years"
Well, OK, thanks Andy - Hopefully the OP got his plate read by a person - at least in court, that person could be asked 'when did you have your eyes tested?' Or at least the equipment could have calibration test records present. I always reckon it is best to look at the legality of the speed limit first and how the road is described in the NIP/Summons - probably because that is how I succeeded and got two mates off speeding in other areas (their cases were 'withdrawn without offering any evidence' when they were challenged).
The speed camera is operated out of the back of the van. The camera on the front just records video. If camera at the rear gets you, they record your speed with a front view, and then get your plate from the camera on the front of the van as you ride past.
If it helps, though i cant speak for all forces if any, 1 all sites used by a camera will have been assessed for suitability and compliance with process ie the required speed enforcement notices. they will also have to comply with a set of rules pertinent to whichever force it is ie not hiding in bins etc etc 2 all speed camera vans have a pretty damm laser accurate camera. If you see them they have already seen you. This will record your speed. 3 All camera vans also record a constant video of the vehicles coming towards the camera and passing. 4 They pretty much all have a camera recording vehicles passing and moving away from them ( i suspect this is where the bike registration number will have been obtained from) 5 once a van completes a tour of duty all material is submitted to an assessor who applies several tests to the evidence , ie how many vehicles are in the photo, is the reg number readable, is there continuity of evidence in the case of this bike, and so on. There have been that many cases where loop hole this or loop hole that have been applied that their procedures should (SHOULD) eliminate Mr Loophole...in theory.
I got caught in 2010, 112 in a 70. I got a 56 day ban and a £150 fine. Taking a ban in my instance cost me £30 more on my insurance renewal. It worked for myself and I worked from home so didn't casue any issues. In 2017, again got caught doing 89 in a 60. I represented myself, and got 6 points and wait for it.....a £680 fine. With hindsight I should not have laid it on thick that being banned would cause unnecessary hardship to others. Should have taken the ban as I'm sure it would have been short. Again, no real damage insurance wise. Yes, I live in North Yorkshire, where the mobile cameras have started doubling up so if you managed to get passed the first one, don't be fooled that you can wind it on and it will be plain sailing, the second will probably get ya. North yorkshire are bragging that they have cameras that can capture your speed at 1500m (and in the dark I'm hearing). Regardless of how you feel about speeding, speed cameras are not solely about safety.... Oh, just to clear one thing up, the mobile camera vans have cameras front and back...
I saw a van up there on Saturday, just north of Settle. At the end of a nice long straight you would want to pelt along. Luckily we were alerted by bikers coming the other way. A motoring lawyer is: https://www.richardsilver.co.uk/ He's done some good work for me and can help mitigate the sentence or if your are really lucky, get you off. He works all over the UK. He's also a biker.
We were riding last thursday just before lunchtime, sunny, not one vehicle in sight either way, (exept the van in the layby near the top of the hill). My mate hasn't had an NIP yet so it looks like he might've got lucky. Cheers for the recommendation.
yeah, theyre looking for my number plates that I rip off, after stopping before I pass the camera. I should probably just put them down my leathers in future, plates arnt cheap these days.........
Here we go - another Plod who can't make his mind up. Corrects me in one post by clearly saying I could be wrong, then in his very next post saying "though i cant speak for all forces if any". Sort your head out Andy, FFS - a decent advocate would rip you to pieces in court with statements like that.
apart from the fact you are wrong, what kind of statement is above.... its blue its blue...but it could be red!...... get over it!
i find it very hard to understand the fact you can only see the evidence against you ( ie picture etc) if you identify yourself as the rider/driver, surly this is not correct( morally or otherwise).. if you accuse me of something, then i would expect to be presented with the evidence and not just a time and date, its a somewhat loaded allegation in my view. luckily i haven't lived in the UK for a few years now, and all the points i managed to get have long gone... hopefully..
It definitely seems to be getting worse. I'm seeing a lot more speed camera vans around. And they're fekkin lethal. It's an absolute turkey shoot. I got nicked recently for 35 in a 30. I was offered a speed awareness course and took it as opposed to 3 points and 100 quid fine. I'm just glad I don't ride on the road any more. I'd probably be banged up! I find it all quite irksome. Whenever I see a camera van I think 66mm anti tank rocket. They hide behind this 'safety' bollox. I just see it all, largely, as a stealth tax.
I had same issue lucky for doing 34 in a 30 - really was not convinced it was me as two weeks after the so call misdeed a plain police car visited a local bike night taking pics of all the white Ducati’s, spoke to Dalton White, who said you’ve been offered the speed awareness corse just do it - we would charge you more and if you ask for pic your basically admitting it was you Not really fair playing field
