What I find a major concern is that when the case was reviewed before proceeding, nobody thought that the copper was a complete cock and trying to show off to his school children. Any sensible person would have dropped the case and a quiet word with the copper would have been in order. Well, a f*c$ing loud word... This part of the OP implies this case was a precedent. That is not so. A decision of a District Judge in a Magistrates Court is never a precedent. Even if the case had been appealed to the Crown Court, the judgment would still not have been a precedent. Only if it had gone up to the Court of Appeal Criminal Division would the judgment there have had the status of a precedent. Incidentally, there seems to be no indication who paid the costs of the case, which must have been substantial. The police? The charity? The individual involved? It would be interesting to know.
I applaud the overall restrained response to the first post of this thread. A worn-out cliche, but this was genuinely wrong on so many levels and as this is the second example of MPC Oliver going after a volunteer trying to save life, surely this officer needs discharging from the Police Force as a minimal course of action/would happily sign any petition in support of this.
