Dont trust the 10% + 2 mph rule!!

  1. you guys do that zero tolerance thing as well don't you?
    my mate was caught last month 46 in 40 and was going
    to get a 3 point ticket but asked the cop for the speed
    awareness course.The cop replied that he was within
    the speed limit(told him 47mph was the cut of for course)
    so that would be okay.
    so do you have to ask the officer for the course when getting
    the ticket or can you apply later??
    im sure there is police lurking about
    on here that can answer.

    Yep, the judge obviously liked you/thought that you were contrite enough/believed your argument to be well reasoned/felt the police were being harsh/whatever. But it's a risk, and in this area of oppressive enforcement of speeding, not one I'd fancy taking if there's a certainty instead.
     
  3. My father had a 33 in a 30 too and got a fine and 3 points.
    The police officer said in certain situations they have a zero tolerance policy for speeding. ( eg school area, black spot blah blah)

    He was entering a 30 from a 40 zone and was the last of 5 cars all doing the same speed. Because he was on the back and easier to stop they picked him out.

    over the limit....not unless you call the judge a wing wearing

  5. Judges sit in crown courts and don't deal with speeding! The best lesson to learn from this is don't speed, and if you do and get caught don't moan about it! And yes I have been caught speeding, and the only person twisting the throttle was me!
     
  6. My speeding case went to Crown Court and was dealt with by a Judge........but it was an Appeal, which incidentally, I won, hands down......because I proved the limit was illegal......research sometimes pays off handsomely.........to the tune of £8K.

  7. Thankfully it's rare, but I can introduce you to a couple of people who did. Mainly seemed to come down to the beak being anti-biking and waking up on the wrong side of bed in the morning - the attitude was very much "You're wasting my time with taking this further, so I'm going to slap you for it"
     
  8. Here's s tip : if it was a fixed camera, measure the distance between the road markings.
    I know someone who successfully fought a ticket on this one. He was (allegedly) just over the limit, but the markings were too far apart so the camera calibration was invalid...
    If it was a hand-held camera then I don't have any tips for them... Sorry !

  10. I have checked several cars and bikes speedo readings by using a hand held G.P.S, and found that all of them over read by a factor of aprox' 10%.
    I then checked the G.P.S with another G.P.S and got exactly the same reading.
     
  11. Best line I ever heard to a Judge was from an RD350LC rider who led the police on a 100mph plus chase for several miles before being apprehended. So the Judge asks, "Do you have anything to to say before I pass sentence?" To which our (well my, anyway) hero replies "If I'd have had a new set of plugs you'd never have f*cking caught me!" The sentence is lost in the mists of time but I still remember that line! :-D
     
  12. Standard for cars and bikes to do this, since over-reading speed is permissible by that margin, but under-reading by any margin at all is a big fine. I always assume than an indicated 80 is nearer 70. And therefore (notwithstanding this thread title) that an indicated 85 on the m-way is probably fine, since 10%+2 gives you 77 and an indicated 85 is probably around 77!
     
  13. I Drive over 1000 miles a week on average, and allways use the speed readout on the sat nav, not the cars speedo, 10% out is about right. i also completelly ignore average speed camera's, they are all fake, but i don't speed in towns and vollages.

  15. If you are doing 33 in a 30, then your speedo would have been showing at least 33mph and probably 36mph, so you can't use it as an excuse. You would have known you were breaking the limit by using your speedo. The rule is meant to avoid a situation whereby your speedo says you were doing 30mph when i fact yoy were doing 36mph and not the other way round IYSWIM.

    That said it does sound very petty to be done for that.
     
  16. Ah but who says either of your GPS items are accurate or indeed calibrated...........and not just both out by the same amount?
     
  17. If the powers that be say she was doing 33 then what relevence does the 10% + anything relate to as her speedo would of been reading even higher.....................she clearly wasnt conscious of what speed she was doing!

    Now if you want to argue about someone being prosecuted for 33 in a 30 then thats a different arguement, unless its her second offence in a given period then i very much doubt that she will be prosecuted.
     
  18. I personally think that your niece should have been wearing stilletos, she should have shoved the sharp pointy heels through the pigs eyeballs and then hammered them in till he expired!

    The Police do a difficult job,hampered by red tape and commanders who are more Politically motivated than otherwise, they are reviled by the general community, (and they are aware of that so shouldnt whine like little girls when they are being slated)...however traffic Police are only there for one reason...and dont all you bleeding heart do gooders go whinging on about Road safety... it isnt about Road safety its about Revenue! 33 in a 30 zone fecking ridiculous! obviously the power hungry twat didnt get a jump that day!
     
  19. clearly you are well informed...:rolleyes: but i think youll find the majority of staff within the majority of speed enforcement team in whatever name they call them are civvys..........

    there really aint such a thing as a traffic cop anymore.......
