I think I might write and ask for the photo / image evidence, stating you can't be certain if you were on that road the day they say. However...............'someone somewhere' might just happen to notice that on this forum you have admitted to the offence......... Plod round this way appear to know who rides what bike and biker's forums exist.
There is an old saying that the man who acts as his own advocate has a fool for a client. Doesn't apply to a simple guilty plea and apology, but for anything more than that - unless you know what you are doing seek advice, or you might go blundering in and making things worse.
If I was summoned to appear in court and was "bang to rights" then I would do the same, and apologise profusely. But if I thought there was a chance that the prosecution could be challenged then I'd want legal advice and robust representation to do that for me.
It's a while (thankfully!) but I've stood twice before the magistrate for speeding. 6 points and a fine each time. They did look surprised that I didn't have representation, or a letter from my employer as to what a temporary ban would mean (they did ask and I said I wouldn't be able to work and would probably be let go). In return I was polite and just apologised. I followed an unmarked police bike (z1000sx) up the A494 couple of weeks ago. Got to say the riding style was pretty aggressive. Had fun keeping up with him though.
there must be two cameras in the van ,I was done by a mobile camera on my bike (only had to attend a speed awareness course).
Going back a few years I had a similar situation in a car. At the time not supplying the details of the driver carried only 3 points and a MS90 code on your license. I ran out of time in supplying the drivers details . Don't say someone else was riding as that'll end badly. I got a decent sized fine (can't remember how much but maybe £400+) and the MS90. Insurance companies hammered me for a bit as it's not a code they see much. On the next occasion I went with honesty is the best policy and went to court. Got a big fine and 9 points. Wish I'd just let the request for details expire if I'm honest.....
From my own experience in court on a speeding charge for doing 109 mph across the Severn bridge at about 11-30 at night after coming back from a Manic Street Preachers gig in Cardiff it all depends who is on the bench in front of you. I had two women and a man on the bench which is not a good sign as women are not in favour of speeding bikes. I was given a 21 day ban and fined about £300 which I guess was better than a load of points for 4 years on your license. The clerk then outside suggested I appeal as she thought I had been treated unfairly as a woman in the case before me was up on charges related to doing 64 in a 30 zone and through roadworks at the same time and she just got a couple of points and a small fine but she did mention she was a foster parent. The same type of offence for me would have meant doing over 140+ on the motorway through roadworks but after considering the clerk's advice I just took my 21 day ban and left. I guess if I had appealed it may has just pissed them off even more, I believe any thing over 30 mph more than the road limit you get banned unless you can provide exceptional reasons for not being banned. For sure it ruins your fun for a while but don't dwell on it too long and you may have a understanding bench on your court day. Good luck and always wear a suit on your court appearance.
I asked before, why is it a 60mph zone? I dual carriageways are 70 unless specifically signed otherwise. if signed 60 is there any way you can enter the dual carriageway without seeing the reduced speed sign ,ie argue you thought it was a 70 zone.
That's just it. Wales constabulary were unable to prosecute anyone who did not sign the papers they returned, the charge has to be dropped, but that's the Welsh force,so the paperwork might be slightly different elsewhere.
A 'friend' Had a similar scenario of being caught well over the 100mph mark. (124mph) Never denied it and accepted his fate and took his day in court with no lawyer. Simply turned up to say sorry and take the beating. The judge told him to go get a lawyer and come back as it was a 2 year ban and £1500. He returned some weeks later with a lawyer and got 6 months ban and £650 fine. Plus lawyers fee of around £250. But still got a better deal by turning up with a lawyer a few weeks later. I believe it's not only the speed but the conditions, time, other road users etc that can be taken into account. Dangerously driving etc. if you can prove you were driving at a fast pace safely without causing danger to yourself for others then it's worth a shot. The police can do it if it's safe !!But with a mobile camera its a bit harder I suppose.
If you are being prosecuted, question 1 is whether you have a defence. Question 2 is whether you have any relevant mitigation. If you don't understand the difference between defences and mitigation points, seek advice!
On the subject of not signing the NIP. I too had this work with a speed camera fine from blackpool. Instead of filling in the ticket, i supplied the info on a piece of note paper stating my misses was driving but didn't sign that letter anyway. Then sent it recorded delivery. We never got a response.
Points = prizes Prize today is : A Bus Ticket Deny everything .. Say you were on a secret mission in the bahamas looking for Dr evil . Send it back and they will probably let you off for being insane ....
I've just this minute opted to take a speed awareness course from being caught speeding in Lancashire about 3 weeks ago. Now get this.........if I opted for the course it costs me £90 and no points on my licence. But if I decide to not to take the course but to take the 3 points and a fine they charge me £100!! How does that work then?
Id just like to wade in with a "grey area" type response.....my mate got caught speeding has gotten away with it twice.... First time he claimed that the office that caught him (with a speed gun) was leaning against the car, thus grounding himself. He then requested the calibration certificate from the speed gun which they couldn't produce. He got away with it. Second time he requested photographs, calibration certificates etc etc....essentially kept requesting information but each time he left it til the last month of each enquiry, from what he tells me each request for information has to be responded with within 6 months....he dragged it out for 18 months by which time they replied that they were dropping it....I think they just got tired of responding!! (Any request which you make must be responded to so he tells me) If any budding QC's would like to put me straight with the above im all ears but he (my mate) has the clean licence still...
