However, in the States, I have heard anecdotal evidence (i.e. not sensationalist newspaper articles but friend-of-a-friend reports) that if you did "execute" a genuine burglar in your own home, the police tend to "fail to find any evidence" of such a thing. Self-defence, case closed. In any event, the wounds described in Pistorius' GFs case aren't as clear cut as a bullet to the back of the head or "two centre mass, one in the head" would be.
What I don't get tho, is how she has been cremated already. We've all seen CSI, they always go back and find something later And no way cold this ever be self defence; in no way was he threatened. Fwiw I'm not convinced he did it to kill her, ie not premeditated, but still murder in my book Altho assuming whenever a trial goes ahead the truth of any abuse will come out
Surely killing in self defence would/could be classed as manslaughter. I'm not an expert on the SA judicial system, but there will be a law that would work in a similar vein to 'death my misadventure'/'accidental death'/justifiable homicide especially given the violey nature of the SA currently and in the past. For the record, I'm not saying it could be one of those, I'm just thinking out loud. Bradders I think they will be playing heavily on the self defence angle despite, in our eyes anyway, a complete lack of threat. Anyway, he's been given bail so the media circus will calm down now until much later this, or maybe even next year, before a trial starts when it will all start up again. He will never run again professionally, SA has lost a National Hero and she has paid the ultimate sacrifice. A very sad story :frown: Personally, I really hope it was a tragic accident. self defence?? so he was threatened by a person on the other side of a door? self defence argument is usually based upon proportional force, or a little but more than what is used against you using a gun is self defence is usually justified when you are either threatened with a knife or a gun, in this case this argument doesn't really hold water but money fame and connections usually buy their own justice, my money is on him walking free from this
You're applying UK values to a different country and situation. A very wealthy friend of mine lives like a recluse in his home north of Manchester. He lives behind security gates, video approved access and double entrance doors to his home because of threats due to his wealth, barred windows and alarms, it's no fun. Imagine the same in a society where in some locations violence is more extreme and the threat of violence perceived as higher.

Often come across as likable "nice " decent guys in public.. But behind closed doors different ball game. Combined with that drive to win .. Not good. Messing with male hormones brings on aggression and short tempers. As I understand it, it is common ground between the prosecution and the defence that P was not actually facing a threat. P's legal defence is that he reasonably believed (genuinely but mistakenly) that he faced a threat, and that he was entitled to defend himself against that threat. That is what "self defence" means in the context of this case. If the court believes P's story, he may be acquitted - but if they do not believe his story it presumably follows that he would be convicted.
