I had a DHS 'test' today. They don't believe the surgeons, consultants and doctors who have written up my notes (that I gave them access to) and my GP who does my sick notes (that I send them) is a bare-faced liar. Instead, I need to go to the job centre in Gloucester to be assessed by a youngster who may be a teenager or early twenties. Unless I am wrong and those years of medical training made her look younger than my kids. The Medical and Disability office is on the first floor of the Gloucester Job Centre. The security staff won't let you go upstairs in case there is a fire. The lift is out of action and they think that you will be trampled on the stairs by the staff rushing to get out. So, you have to wait in the job centre for the youngster to come down to you. I think the catch is that if you can get to the Job Centre (12 miles from me) then you must be fit enough to work. Or you don't show up for the assessment in which case they stop the benefit. Either way the benefit is stopped. Now that Boris is in power with a huge majority, they are safe from criticism. I only bothered with this farce because my solicitor said that the other side will assume that I have received job seekers allowance (although I am not a jobseeker) and deduct it from my claim. So If the DHS write and tell me that I can't have it, then I have written proof that I don't receive it and therefore they can't get away with deducting it from the claim! Although they still deny liability! After their client admits liability and is prosecuted by the Police! I never realised that a no fault accident would descend me into 'la-la land'. But it has!
Ib some ways, I wish that the accident was my fault. At least I would not have to deal with his sh1t!
Sounds like the same crap I went through here after my accident last year. It almost seems as if an admission off guilt is key to making the innocent party's life a total misery. Hope you get it resolved to your satisfaction.
Well last night I had one of my Xmas presents..........a meal in a tiny restaurant called the Secret Italian in Barnsley (https://www.tripadvisor.co.uk/Resta...Italian-Barnsley_South_Yorkshire_England.html) The place is situated on a little industrial estate on the edge of Barnsley, is tiny and only has 12 covers and is run by a very mad and enthusiastic Italian lady called Claudia who is mad as a hatter but cooks and serves the most delicious and authentic Italian food. It was just like mama used to make, which is the highest praise I can give! There is no menu......you get what you are given. But what you are given is wonderful and lots of it. You definitely leave podgier than you went in. They dont have a drinks licence so it's a BYO. We had salami, provolone cheese, olives, mozzarella and meatballs for starters. Followed by home made bruschetta (pane e pomodore). The pasta dish was pasta alla matriciana . Followed by roast chicken and vegetables. Followed by steamed fish and spinach. Finished off with home made tiramisu........which was to die for! The decor was like a traditional Italian kitchen but paid homage to Italian biking and motoring as Claudia is a petrol head. When I told her I had two Ducati's she told me tales of her visits to Borgo Panigale and meeting her hero Carlos Checa there. Anyway, if you fancy a real and traditional Italian eating experience in South Yorkshire I would definitely recommend The Secret Italian and Claudia. The broken system fella, so sorry you are going through all this and guess what it ain't about to get any better. The guy in charge of the Universal Credit roll out was on TV a couple of nights has predicted it will now take till 2033 to be achieved at increased cost of £3 billion so far !
They make things harder for themselves. They choose not to believe very highly qualified medical staff but prefer the word of their own unqualified people. I know this pisses off my GP (who hates them) as they choose not to believe his fitness to work forms. So, they don't believe a GP with a degree in medicine plus many years of training but believe their own teenage employee who they know have no clue and will just cause them to cave in when threatened with court action. Mad and you couldn't make it up!
it's not quite clear what you are claiming what I can do is give you my brothers experience who claims esa and pip and had both re-assesments last september. They do centralise the assessments and yes they will use it against you. If you claim anxiety, depression, agrophobia, medical but turn up in a town centre, they mark you down. If you drive there and tell them, they tell you that you are of clear enough thought to drive/physically able to drive without impairment, plan routes and concentrate . Knowing they did, this I drove him to his interviews. What we didn't realise but are now aware of, you can refuse to go to these assessments, BUT it must be medically backed up with why. Unless it is medically backed up, they will sanction you for not turning up. If you have medical support that there is an issue, you can ask for a home visit. They will try and give you another date, you will point out again the issue and eventually you can in specific circumstances, get a home visit Most of those you see are listed as medical professionals. Given the age of those taking the interviews, I would wonder if many have gone beyond first aid or a year in nursing. You can ask what their experience is but they are not obliged to clarify. it can take several weeks to await the decision and even when it turns up it can still be lowered. You can then ask for a "review of the decision", this is not an appeal but a halfway. my brothers assesment from the september assesment came through at a lower rate in January, he asked for it to be reviewed straightaway and needed to send more paperwork in to support the request. He got a text at the end of january telling him they will review and it could take uptil 10 weeks. If he loses that review, he then has to appeal "offically which is likely again to take a further 10 weeks.
Thanks, that is useful. I'm only doing this rubbish because my solicitor told me that the other party will deduct from my claim. If I get a letter refusing my claim then that will stop the other party deducting it from my claim - I think! When I was in council run accommodation (as they wouldn't let me home at first) a guy who specialises in helping people claim did the claim for me. I think that it is Universal Credit and disability allowance. At first, they accepted the claim but would not pay anything as I wasn't home. The fact that it wasn't a hospital and I had to do my own shopping didn't count for much. When I was home, they started paying but the guy who helped me doesn't cover my home area.
