Stopped for no road tax, allegedly ....

  3. Sec 164 RTA................if you do not produce the documentation there and then you ARE technically committing an offence, but out of the goodness of their heart you can get 7 days to produce said items at a police station of your choice.....

    Then there is the specific offence of failing to display....

    I would suggest that you and your vehicle were pinged with a no tax marker on an anpr camera somewhere. A 'No tax' marker normally takes a couple of months from the tax running out to go on the system against a vehicle. So it would be fair to say you were fair game with no tax and potentially no insurance as people cant tax their vehicle without insurance....Im sure those that do pay the extortionate rates of tax for everything in the UK are more than happy for the powers that be to look to enforce these rules, i have to pay it so therefor so should every one else!

    Now these days a vehicle is either taxed or declared SORN there is generally no grey area, .........so perhaps you havnt been using your bike the past two summer months during all this glorious weather and this was the first time out on it in two months or more:rolleyes:, im just saying......


    now about the attitude test...........does that exist? no one here is sensing that that may have been part of this situation...........

    I wouldn't take that attitude with you to Europe,you might end up in the choky for a spell

  7. What about if you buy online and your waiting for the disc to turn up?
    I know I guess you should buy it in time to be there before the other one runs out.
    But I just changed car and got my reminder form late from them :(
    My tax disc is still " in the post" but paid for days ago.

    then what happens when they say, 'these are photocopies, you could have knocked these up on your computer'...

    'oh well, just get duplicates, its only £30, better than getting a £70 fine'.
    then one day, you forget you docs, leave them at a mates, the MOT centre, wherever...then someones got all of your details..nah, dont think so..just in case a pissed off pig decides to have a go....then seeing as you forgot all this crap youve got to carry around its your lucky day, and thats the day you get stopped and fined for having no docs...'Well, you shouldnt have mislaid them should you..keep a spare set under the seat'..blah blah...

    i cant stand this, 'well if youve done nothing wrong youve got nothing to fear' type bullshit...holds no water whatsoever and is the foot in the door..it happens all of the time....then a new law presses home the advantage and no one kicks up a fuss because its such small increments of encroachment.

    Noods....fekk em. its NOT a legal requirement to have all of your legal docs on you all of the time.
    You dont even have to give your name to a copper unless he has just cause (which is fully explained to you at the time) to suspect you of being involved in a CRIMINAL act....

  9. As Andy has pointed out, you have simply been "blobbed" for failure to display. You are required by law to carry all documents but in the UK you are given 7 days grace to produce. Having no disc displayed and the relevant details not showing on pnc, is only going to end with one outcome I am afraid.
     
  10. So it appears that Andy is telling us that it's an offence not to have all relevant documents to hand? That's a new one on me.

    I also read somewhere that actually producing your documents on the spot can be seen by courts as a tacit admission of guilt to certain offences and that you should never produce your documents on the spot.

    I have no idea how true that is but it would appear that with things legal and officers of the law it is never clear cut.

  11. Spot on........you don't even have to have your licence with you.

    Fair enough for not displaying the disc, but if it had been applied for and was in the post, then Plod could not nick someone for it......well, they could try; but as the actual 'nicking' is more or less on behalf of the DVLA, then it would never hold up in court anyway.

    Seems like more typical Plods not knowing the law.

    Drivers are not legally obliged to carry a driving licence while driving, but section 164 of the Road Traffic Act 1998 allows a police officer to require a driver to produce a driving licence within seven days at a police station chosen by the driver.

    Therefore the only offence that could be committed is:

    'Non-production of documents within a specified seven day period'

  13. Documents you get a producer .. 7 days to bring them to the cop shop .
    Oh joy this has happened in my neck of the woods :( :( :(
    I'm still waiting for the fecking disc to show up!

    Also interesting and true..,
    If you break down and call out RAC or AA or Green flag unless you have a current tax disc on display they will not touch your vehicle !!
    They are not allowed to tow it either or recover it!
    This happened when in a friends car last year who also had purchased online and was waiting for disc in post .

    The recovery people will only help you if a current tax disc is displayed.

    I'm never buying online again ....
     
  14. i have a retired policeman that helps around the place who hates the general attitude of the police. about 90% of first and only contact with them is through visor or drivers window,more often than not they are aggressive and balls out rude. they make a rod for there own back and on on the hole deserve the back lash of the general public.

    I know a few round my way and some are nice and il have a chat ...
    It's the young newly qualified ones who are out to prove themselves I've found bit grim.
     
  16. I have to say that the attitude of the officers as referred to by the OP does them no favours either.

    Is this really the sort of policing we want to see on our streets? Road users just seem to be an easy target for lazy policing these days.

I have a close relative Plod.......he tells me that in his force, conviction targets are still issued........they all know that motorists are the easiest way of meeting the targets; the volume of nicked motorists provides a steady revenue of fines; very few cases are challenged; therefore low prosecution costs and very little risk of failure.

  19. nah.......there may be "targets" for burglary violent crime and whatever the buzz phrase of the month is...........but not for motoring with my lot.............tht said if you drive whilst using your phone, drive whist under the influence, no seat belt particularly on minor passengers, and finally the dreaded speed thing, then you may well be prosecuted or on the spot fine or leave yourself open to scrutiny for any other offences.....
     
  20. Ah the thread moves from specific incident to generalisation .......

    Road users as in the attitude of the OP, the bloke with no tax displayed banged to rights, who still wont admit a) he had fooked up, and b) he clearly doesnt know the rules!

    My bet is it was a computer check that was saying no tax, he had only just taxed it so the computer catches up in say 24hrs, he was stopped to investigate the no tax, has gone off on one instead of listening to the reasoning behind being stopped, so instead of an apology wrapped up in words of advise the rules were enforced to their letter.............. ah discretion.......
