Stopped for no road tax, allegedly ....

  1. I cant help thinking that if your attitude had been more along the lines of "I didn't realise it was a requirement to display it the tax disk, I'll put it on as soon as I get home", you might have got away with it and not been £70 lighter. It says it on the bit of paper attached to the disk that you've got to display it.

    So often its down to attitude and whether you want to push back or go with what they're saying. I don't think its about pride or arrogance. They're doing a job (the political conversations about what their 'job' should be aside) and have stopped you for coming up on their system as not having road tax and its right that they should stop you for that. Having said that, obviously their system was wrong and its frustrating to be accused of something you've (not) done.

    On one hand you have my sympathy....on the other I think you could have got away with it.

    In the meantime cough up.....someone needs a new duck island.
     
  2. Unfortunately that's not the case, I was pulled up for no road tax on the van after plod checked with the ANPR but the van had been taxed for 2 weeks and on display, also not all insurance companies are passing on there information efficiently resulting in more confusion.
    After the police had a good look around the van he said perhaps the system was a bit slow.

  3. It must vary from place to place as to how quickly the information at DVLA is updated. I MOT`d my R1 a few months back, rode the 10 minutes back from the MOT place to home, went online to get my road tax and they already knew it had passed its MOT when they did their little check. Ordered road tax and jobs a good un.

    I never let my road tax run out if its a vehicle im using, I get the reminder through from DVLA in plenty of time, re-order new on online and it turns up before old one has run out.

    As for old bill... ive never ever displayed my road tax on my bike in the 20 odd years ive been riding. Ive had numerous stops, crashes and incidents with the old bill for a variety of other reasons, and never once been done for not having road tax visible. They always give me the 7 day producer for insurance, mot & license. Not a word about tax. Guess its luck of the draw.
     
  4. I was stopped a couple of years ago by a bike cop and he asked me where my tax disc was. He said 'I don't mind if you keep it under your seat, as long as you can show it to me'. I was going to say how pleasantly surprised I was with this 'understanding attitude', then he got his little metal ruler out and fined me for having numbers 3mm too short on my plate...ho hum :rolleyes:

  5. As I said earlier, if the tax disc was renewed even though the old one hadn't expired, you have 14 days in which to display the new one........

    .........so in reality as the law clearly states you have 14 days, you could tax your vehicle on the last day of the month, then drive around with the old expired one for 14 days before you fit the new one..................but could you?

    Because the law states you 'must display a current tax disc'......

    ............so that means you can drive around for the 14 days without one at all.

    Looks like they will try and get you one way or another.....

  6. Also that's for tax bought on the phone or online that you get 14 days. Not bought from PO like the op.

    Still.........It matters not, because you can aways check you are insured on AskMid website and check the tax status on the DVLA site....

    ..........you would be suprised as to how long the AskMid site takes to update though, but the DVLA one is pretty quick. Never seen my road fund licence renewal appear on their site any later than 24 hours after I applied for it.

  8. Application is not made at the PO, you turn up and buy it.

    Telling the Officer that you had bought it and is sitting on your desk doesn't go far in helping the matter.

    Just who is offended? IM certainly not.

    As a minor point..and correct me if im wrong, but, so-called road tax was abolished in 1937 by Winston Churchill. Road Tax was used to maintain and develop the road network.

    Road fund Licence has nothing to do with road maintenance..."Road fund" is mistakenly thought to mean "fund the road" when it actually means "road/transport account".

    You also apply for a licence disc. The inference being of course, that the application can be denied, even upon paying the demanded premium. You do not buy a licence as such, you do not own it, but you are permitted to use it. It is essentially a rental agreement. For a fee, you can use it..rather like clicking the 'yes' box when installing software..you dont own the software, merely the permission allowing you to use it (which can be revoked by the owner). the licence is the identification voucher, or permission number.
    Of course, you could de-register your vehicle, in which case it becomes MOT and tax exempt...allegedly.

    The Governement website clearly states 'when you renew it'......not 'I bought it down Tescos, mate' or 'I got it in the Post Office'.......

    ........when you go into the Post Office, you are either renewing it or you are applying for it.

    Here is the actual paragraph:

    Since 17 July 2013, when you renew your vehicle tax or when your new car is taxed for the first time, you now have up to 14 days to display the new tax disc on the vehicle. Under the old rules, you had just 5 days to do this.
    For renewals, this extended period will only apply when your application to renew your tax disc is made before the previous one expires. If the application is made after the current disc expires, then the vehicle will be treated as untaxed and the 14 day rule will not apply.
     
  11. Oh, and as a point of reference...never ask a police officer/constable (two different roles) for details about the law. They do not know. They are not adequately trained in law. Much of the legal 'knowledge' that the majority of PC's have is erroneous and misguided.
    Its rather like asking the receptionist at the GP's to diagnose your ailment. To say that PC's have a cursory knowledge is to be generous at best..they are trained to carry out their duties as required by the establishment that is utilising them.
    As a barrister once said to my step mum when she was wrongly accused of theft:
    "Luckily for us, the Police are utterly incompetant".
    The case was thrown out.

    I have not received the tax disc. Can I use the vehicle without the tax disc displayed?When you apply for a tax disc online or by using DVLA's phone service you are able to legally continue to drive your vehicle for up to 14 days after the tax disc has expired while you wait for the new tax disc to arrive. This will only apply when you have applied for a new tax disc before the current one expires. You should continue to display the expired disc on your vehicle, until the new one arrives
     
  14. This is an interesting misconception.

    On average, you need to be earning £90k per annum to be a nett contributor. Even then, one trip to the hospital and you are back in the red.

    Of course those of us who choose not to procreate are less of a burden on the state.

    Back on topic. Generally, I find the police to be pretty good, especially the traffic guys. Having said that, I did challenge the traffic cop that pulled me over for a "safety check" on a 3 month old bike with less than 1000miles on the clock. Since I bought it new, it had to be taxed and insured. No need for an MOT.

    He didn't look at anything on the bike. Just ran the computer checks. Waste of time

    traditionally, the greatest barrier to entry was having a limited inside leg measurement, or possibly a free will.

  18. I have just received my tax renewal on the form it says:-

    You will have an extra 5 working days to display your old tax disc if you tax your vehicle on line or by phone on or before September 30 2013

    If you can't tax your vehicle on time for example getting an MOT or insurance for your vehicle, by law you as the registered keeper will not be committing an offence as long as you tax the vehicle or make a SORN WITHIN 14 days of the date your tax disc or SORN RUNS OUT
    However you must keep your OFF THE ROAD during this time
