As I understand it the evidence it quite strong, the gray area is whether that evidence can be used. 1. Sollecito's Dna and Kerchers also are on a knife found at his home but the defense claim it was there from cross contamination. 2. Knox confessed to being in the house and hearing Kercher screaming but later retracted it when her solicitor arrived. As she did not have representation her confession is not admissible and she claims she was confused. 3. Sollecito's DNA is also on Kerchers ripped off Bra clasp, but they claim cross contamination again. 4. They found a bloody footprint in sollecito's bathroom but couldn't prove it was his 5. someone staged a break in to make it look like a Burglar but no one has been able to actually climb to that window when testing the theory. You would have to say that whilst that evidence may or may not have been contaminated, a lot of it points to both Knox and Solicetto knowing more than they let on. My own hunch is that Solicetto or someone he was with killed Kercher and Knox probably helped them cover it up. She comes across as quite a dark character to me.
I think you could take her silence two ways: 1) Guilty and doesn't want to appear in public/on TV to try and convince the world of her alleged innocence, through fear of ending up being pitched opposite someone like Paxman/Frost (if he wasn't dead), who might be able to uncover some small sign of her being guilty, or caving-in and admitting it all to the world. 2) Innocent and wants to forget the whole episode, avoid the media circus and hope the whole thing goes away, with the majority of people forgetting who she is in a few years etc. Whilst i've not been in prison, i can only assume it's a horrific experience and the mental scars she probably bears will take years to heal, if ever. Personally, i'm thinking about the bloke who was jailed for his part in it all, what has he said about her involvement.....if anything? To be honest i've not followed it that closely, and we've all been presented with selected evidence/opinions/horseshit from the media, who love to damn everyone, knowing they'll face few repercussions for their opinions. So who can honestly say if she's guilty or innocent? Not me.......and it's looking like the Italians aren't sure either.
I think the relevant term is " Beyond reasonable doubt " , and that there is in truck loads . I think its time the Italians admit they totally botched the prosecution and forget the case . At this point Im sure the only reason this is still going is because the Itie's havn't got the integrity to admit they fucked it up and they will do anything to save face . When it comes to running a country the Italians have always been incompetent , relying on theatrics and arse licking ( Hitler springs to mind ) rather than common sense
